palities; authority of County Manager," Section 2-141, titled "Purchase
and use of photostatic equipment," and Section 2-142, titled "Plans
for employees' insurance and hospitalization, etc.," to authorize the
County to contract with municipalities for services to be performed
by the County; to authorize the County to purchase photostatic equip-
ment; to authorize the allocation of the use of photostatic equipment;
to authorize the County to adopt plans for group health and hos-
pitalization; and to delete an obsolete reference to the prior Mont-
gomery County Charter.

Be It Enacted by the County Council for Montgomery County, Mary-
land,
that—

Section 1. Section 2-140, Chapter 2, titled "Administration," of the
Montgomery County Code 1965, is hereby repealed and re-enacted, with
amendments, to read as follows:

2-140. Services to or purchases for municipalities; authority of County
Manager.

The County Manager is hereby authorized, by contract, to provide to
any incorporated town or taxing area upon payment therefor, any work or
services of the type, which at the time of the execution of such contract,
the County Government performs for the County. Any such contract shall
specify the particular services to be performed by the County and the fee
shall be fixed in an amount not less than the cost of services to the County,
including a reasonable allowance for overhead costs. Such contract shall
also provide the date upon which it shall become effective, the duration of
the contract, the time and manner of payments to be made thereunder
with provision as to the effect of nonpayment and procedures for collection.
Any such town or taxing area which receives and pays for such work or
services shall not be liable in damages to any person solely on the claim
that such work or services were performed in a negligent or faulty manner
or that damages or injury resulted from the performance thereof in such
manner. The County Attorney shall, without charge, represent and
defend in court, if necessary, any such town or taxing area in any suit,
claim or demand made or brought against it on any such claim.

Section 2. Section 2-141, Chapter 2, titled "Administration," of the
Montgomery County Code 1965, is hereby repealed and re-enacted, with
amendments, to read as follows:

2-141. Purchase and use of photostatic equipment.

The County is hereby authorized and empowered, whenever it deems
it necessary or expedient, to purchase photostatic equipment, material and
supplies for the use of any and all departments of the government of the
County in the photostating and reproducing of documents and other
necessary papers, and for the use of the several service aid councils
established within the County to assist returning veterans of the armed
forces of the United States within the County in the photostating and
reproduction of necessary documents and papers. The County is further
authorized and empowered to assign or allocate such equipment, material
and supplies at any place within the County for use for the purposes herein
stated.

Section 3. Section 2-142, Chapter 2, titled "Administration," of the
Montgomery County Code 1965, is hereby repealed and re-enacted, with
amendments, to read as follows:
