76-30. Duty of owner to obtain license; fee; no fee required for "dog
guides."

Every person owning or harboring a dog within the County shall on
or before July 1 of each year or within ten days of acquiring any dog over
four months of age or within ten days after any such dog becomes four
months of age obtain an annual license for each dog so owned or harbored,
except dogs kept under a kennel license as provided in this Division. The
fee for all such individual dog licenses shall be four dollars, except that no
fee shall be charged for the licensing of any "dog guide" trained to aid
the blind and actually in use for such purpose. When application is made
between January 1 and May 1, and the dog was not subject to licensing
prior to that date, the license fee shall be one-half the above specified
amount. The County Executive may increase or diminish such fees to an
amount not to exceed the costs of administering and enforcing this
Ordinance.

Section 12. Section 76-40 of Chapter 76 of the Montgomery County
Code 1965, titled "Animals and Fowl," is hereby repealed and re-enacted,
with amendments, to read as follows:

76-40. Maintenance of vaccination clinics.

The Health Officer shall maintain at least annually vaccination clinics
at convenient locations in the County for such periods as he shall deem
necessary, and all dogs may be vaccinated at such clinics during such
periods. The County Executive shall establish a fee for vaccinations not to
exceed the costs of administering vaccinations.

Section 13. Section 76-46 of Chapter 76 of the Montgomery County
Code 1965, titled "Animals and Fowl," is hereby repealed and re-enacted,
with amendments, to read as follows:

76-46. Duty of Health Officer to report danger of rabies.

Whenever the Health Officer finds that there is a danger that rabies
exist or may be introduced in the County, it shall be his duty to report the
same to the local Board of Health thereof.

Section 14. Section 76-47 of Chapter 76 of the Montgomery County
Code 1965, titled "Animals and Fowl," is hereby repealed and re-enacted,
with amendments, to read as follows:

76-47. Proclamation of quarantine; notice.

Whenever the danger of rabies is so reported as provided in the
preceding Section, and the local Board of Health, in its discretion, believes
it necessary to prevent the spread thereof, it shall, in order to protect
human life and safety, by simple resolution, proclaim a quarantine on
dogs for all or any portion of the County. Such quarantine may be pro-
claimed for such length of time as the local Board of Health, in its
discretion, may deem necessary; provided, however, that when such dog
quarantine as mentioned in this Section is proclaimed, notice thereof
shall be given to the public by posting or otherwise.

Section 15. Severability.

The provisions of this Act are severable and if any provision, sentence,
clause, section or part thereof is held illegal, invalid or unconstitutional
or inapplicable to any person or circumstances, such illegality, invalidity
or unconstitutionally, or inapplicability shall not affect or impair any of
the remaining provisions, sentences, clauses, sections or part of the Act or
