their application to other persons or circumstances. It is hereby declared
to be the legislative intent that this Act would have been adopted if such
illegal, invalid or unconstitutional provision, sentence, clause, section or
part had not been included therein, and if the person or circumstances to
which the Act or any part thereof is inapplicable had been specifically
exempted therefrom.

Section 16. Effective date.

This Act shall take effect on December 7, 1970.

Chapter 15
(Bill No. 11-70)

An Act to amend Chapter 11, titled "Health and Sanitation," of the
Montgomery County Code 1965, as amended by Chapter 47, Laws
1969, by amending subsection (a) of Section 11-13, titled "Authority
to establish service and disposal plants, contract for collection and
removal, etc.," to authorize the County rather than Council to estab-
lish and maintain and administer refuse disposal plants, license or
contract for the collection and/or disposal of refuse, to contract for
the construction and/or operation of disposal plants.

Be It Enacted By the County Council for Montgomery County, Mary-
land,
that—

Section 1. Chapter 11, subsection (a) of Section 11-13, Montgomery
County Code 1965, as amended by Chapter 47, Laws 1969, is hereby
amended to read as follows:

11-13. Authority to establish service and disposal plants, contract for
collection and removal, etc.

(a) The County may:

(1) Establish and maintain such service and disposal plants as it
may deem necessary or desirable for the collection and disposal of refuse,
and fix the charges for such service, and to this end the County may
establish and provide for the administration of a special service charge
area to be known as the "Refuse Collection District." All service charges
imposed on property within the said Refuse Collection District shall be
collected in the manner in which ordinary taxes are or hereafter may be
collected under the provisions of the general and local laws of the State
and County; and, upon default in the payment of any service charge, the
property against which such service charge has been made shall be sold at
tax sale in the same manner as real property is sold for non-payment of
ordinary taxes.

Section 2. This Act shall take effect December 7, 1970.

An Act to repeal and re-enact, with amendments. Section 9-3, titled
"Number of election districts," to repeal in its entirety Section 9-3A,
titled "Election districts," to repeal Section 9-4, titled "Tenth District
