including provisions for permits, fees, reports and reasonable inspection
of premises necessary to such administration and enforcement, and penal-
ties for the violation of such laws.
Section 2. Section 3-6 of Chapter 3 of the Montgomery County Code
1965, titled "Animals," is hereby repealed in its entirety.
Section 3. Section 3-7 of Chapter 3 of the Montgomery County Code
1965, titled "Animals," is hereby repealed and re-enacted, with amendments,
to read as follows:
3-7. Impounding dogs and other animals—Authority to operate and con-
struct pound.
The County is hereby authorized and empowered to establish, maintain
and operate within the County upon land now owned by the County or to
be hereafter acquired for such purpose, directly or by contract, a pound,
or place of confinement for the removal, care and disposition of licensed
or unlicensed dogs or other animals which may create a menace to the
health, safety and security of the residents of the County; and it is further
authorized and empowered to adopt and enforce all needful rules and
regulations for all and any of the purposes herein mentioned, and to
provide therein reasonable reclaiming fees and charges in connection
therewith.
Section 4. Section 3-8 of Chapter 3 of the Montgomery County Code
1965, titled "Animals," is hereby repealed and re-enacted, with amendments,
to read as follows:
3-8. Same—Authority to enter into contracts as to removal, care and
disposition of impounded animals.
The County is authorized and empowered to enter into a contract or
agreement with such person as it may deem suitable, for the removal,
care and disposition of licensed or unlicensed dogs or other animals as
hereinabove set forth, on such terms and conditions and for such compen-
sation as may be agreed upon between the parties.
Section 5. Section 76-3 of Chapter 76 of the Montgomery County Code
1965, as amended, titled "Animals and Fowl," is hereby repealed and re-
enacted, with amendments, to read as follows:
76-3. Administration of Article.
The Chief Administrative Officer is hereby authorized and directed
to administer this Chapter, subject to the direction of the County Execu-
tive, and to cause to be made such annual enumerations of dogs within the
County as he deems necessary to ensure the proper enforcement of this
Section.
Section 6. Section 76-4 of Chapter 76 of the Montgomery County Code
1965, as amended, titled "Animals and Fowl," is hereby repealed and re-
enacted, with amendments, to read as follows:
76-4. Applicability of Article.
The provisions of Divisions 1 and 2 of this Article shall apply through-
out the County, unless otherwise indicated, but shall not apply within the
corporate limits of any incorporated city, village or town within the County
which by law has been given express authority to regulate and license dogs;
provided, however, that if any such city, town or village shall adopt this
Section and request the County to enforce its provisions within the cor-
