2392                               County Local Laws

76, titled "Animals and Fowl," of the Montgomery County Code 1965,
as amended, by repealing and re-enacting, with amendments, Section
76-3, titled "Administration of Article," Section 76-4, titled "Ap-
plicability of Article," Section 76-18, titled "Injured or diseased dogs
and cats generally," Section 76-24, titled "Same—Disposition of such
dogs," Section 76-25, titled "Unlawful concealment," Section 76-29,
titled "Issuance generally," Section 76-30, titled "Duty of owner to
obtain license; fee; no fee required for 'dog guide'," Section 76-40,
titled "Maintenance of vaccination clinics," Section 76-46, titled "Duty
of Health Officer to report danger of rabies," and Section 76-47, titled
"Proclamation of quarantine; notice," to authorize the County Council
to regulate generally the licensing and humane treatment of dogs,
the business of selling, boarding and breeding of dogs, the operation
of animal hospitals, the care, treatment, vaccination and humane
destruction of animals; to authorize the County to establish and
operate a dog pound and adopt rules and regulations therefor; to
authorize the County to enter into agreements for the removal, care
and disposition of impounded dogs; to provide for the administration
of Chapter 76, titled "Animals and Fowl," of the Montgomery County
Code 1965, by the Chief Administrative Officer, subject to the direction
of the County Executive; to authorize the County to enter into agree-
ments with municipalities adopting Chapter 76; to authorize the
County to enter into agreements with veterinarians for the care of
injured or diseased animals; to provide for the notification of the
owner of a dog involved in an attack on livestock by the County; to
provide that it shall be unlawful to conceal a dog or cat from an
official authorized by the County; to authorize the County Executive
to designate the time and place for the issuance of dog licenses; to
authorize the County Executive to increase or diminish dog license
fees; to authorize the County Executive to regulate the fees for rabies
vaccinations administered by the County; and to delete redundant
references to the County Council.

Be It Enacted by the County Council for Montgomery County, Mary-
land,
that—

Section 1. Section 3-5 of Chapter 3 of the Montgomery County Code
1965, as amended, titled "Animals," is hereby repealed and re-enacted,
with amendments, to read as follows:

3-5. Dogs and cats—Authority to regulate.

The County Council is authorized from time to time to provide by
law, insofar as the subject matters thereof are not provided by public
general laws for the licensing of dogs and the impounding and humane
destruction of unlicensed dogs; for the regulation of the business of board-
ing, selling or breeding dogs or cats and in the operation of hospitals for
dogs or cats, for the seizure, quarantine and treatment of dogs suspected
of having rabies; for the protection of livestock and poultry against
damage by dogs and for the reimbursement of owners of such livestock
and poultry for such damage; for the collection and disposal of dead dogs
and cats and the care of injured dogs and cats; for the seizure and confine-
ment of dangerous and diseased dogs and cats, female dogs in season, dogs
and cats running at large within the County, and dogs found on public
recreation areas and on school grounds on school days and not on a leash
or chain or under a muzzle; for the control of dogs and cats creating public
nuisances; for the protection of dogs and cats from illegal killing, maiming
or poisoning; and for the administration and enforcement of such laws,
