Section 8. Chapter 87, titled "Garbage and Refuse," Section 87-21,
of the Montgomery County Code 1965, is hereby amended as follows:

87-21. Penalty for violations of Chapter; injunctive, etc., relief.

Any violation of any provisions of this Chapter shall, upon conviction
thereof before a court of competent jurisdiction, be punished by a fine of
not more than one thousand dollars or by confinement to the County jail
for not more than thirty days, or both such fine and imprisonment, in the
discretion of the court. Each day a violation of the provisions of this
Chapter continues to exist shall constitute a separate offense. In addition
thereto, the County may institute injunctive, mandamus or any other
appropriate action or proceedings at law or equity for the enforcement of
this Chapter or to correct violations of this Chapter, and any court of
competent jurisdiction shall have the right to issue restraining orders,
temporary or permanent injunctions or mandamus or other appropriate
forms of remedy or relief.

Section 9. Chapter 91, titled "Housing Standards," Section 91-17, of
the Montgomery County Code 1965, is hereby amended as follows:

91-17. Penalty for violations of Chapter; injunctive, etc., relief.

Any person convicted of a violation of any provision of this Chapter
before a court of competent jurisdiction shall be punished by a fine of not
more than one thousand dollars, or by confinement to the County jail for
not more than thirty days, or both such fine and imprisonment, in the
discretion of the court. Each day a violation of the provisions of this
Chapter continues to exist shall constitute a separate offense. In addition
thereto, the County may institute injunctive, mandamus or any other
appropriate action or proceedings at law or equity for the enforcement
of this Chapter or to correct violations of this Chapter, and any court of
competent jurisdiction shall have the right to issue restraining orders,
temporary or permanent injunctions or mandamus or other appropriate

Section 10. Chapter 103, titled "Streets and Roads" (Road Construc-
tion Code), Section 103-21, of the Montgomery County Code 1965, is hereby
amended as follows:

103-21. Penalty for violations of Article.

Any person violating any provision of this Article shall be punishable
by a fine not exceeding one thousand dollars or imprisonment for not more
than six months, for each offense, and each day's violation shall constitute
a separate offense. This Section shall not apply to subsections (b) and
(c) of Section 103-16 of this Code.

Section 11. Chapter 105, titled "Swimming Pools," Section 105-7, of
the Montgomery County Code 1965, is hereby amended as follows:

105-7. Penalty for violations of Chapter.

Any person who violates any provision of this Chapter shall, upon
conviction thereof, be fined not more than one thousand dollars or be
imprisoned for not more than six months, or be both so fined and im-
prisoned. Each day such violation is committed or permitted to continue
shall constitute a separate offense and shall be punishable as such
hereunder.

Section 12. This Act shall take effect on the 76th day following its
enactment.
