(b) No person shall use on the exhaust or "tail pipe" of a motor
vehicle any extension or other device to cause excessive or unusual
noise.
(c) The engine, power, and exhaust mechanism of every motor
vehicle shall be equipped, adjusted and operated to prevent the [con-
tinuous omission of excessive fumes or smoke, but in case shall
such omission be
(1) As dark or darker in shade as that designated as No. 3 on
the Ringelmann Chart, as published by the United States Bureau of
Mines; or
(2) Of such opacity as to obscure an observer's view to a degree
equal to or greater than does smoke described in paragraph (1) of
this subsection.] emission of visible smoke or fumes, exlusive of
water droplets, in the proximity of the exhaust outlet:
(i) while stationary or
(ii) while in motion, except for a period of time not to exceed
five seconds.
1. NO MOTOR VEHICLE SHALL BE OPERATED, NOR
SHALL THE OWNER OR LEASEE OF A MOTOR VEHICLE
PERMIT IT TO BE OPERATED, UPON THE PUBLIC HIGH-
WAYS OF THE STATE UNLESS THE ENGINE POWER AND
EXHAUST MECHANISM SHALL BE EQUIPPED, ADJUSTED,
AND OPERATED TO PREVENT
(I) THE DISCHARGE OF EXCESSIVE CLEARLY VISIBLE
SMOKE (COMPARABLE TO SMOKE EQUAL TO OR DARKER
IN SHADE THAN THAT DESIGNATED AS NO. 1 OF THE RIN-
GELMANN CHART AS PUBLISHED BY THE U. S. BUREAU
OF MINES) IN THE EXHAUST EMISSIONS WITHIN THE
PROXIMITY OF THE EXHAUST OUTLET WHEN VIEWED
THROUGH A CROSS SECTION OF THE EXHAUST PLUME,
FOR MORE THAN TEN (10) CONSECUTIVE SECONDS;
(II) THE DISCHARGE OF SMOKE FROM ANY OTHER
PART OF THE ENGINE IN SUCH AMOUNTS AND OF SUCH
OPACITY AS TO PARTIALLY OBSCURE PERSONS OR OB-
JECTS FROM VIEW.
2. SMOKE IS DEFINED AS SMALL GASBORNE AND AIR-
BORNE PARTICLES, EXCLUSIVE OF WATER VAPOR, FROM
A PROCESS OF COMBUSTION IN SUFFICIENT NUMBERS TO
BE OBSERVABLE.
3. NO MOTOR VEHICLE ENGINE SHALL BE ALLOWED
TO OPERATE FOR MORE THAN FIVE (5) CONSECUTIVE
MINUTES WHEN IT IS NOT IN MOTION EXCEPT AS FOL-
LOWS:
(I) WHEN A VEHICLE IS FORCED TO REMAIN MOTION-
LESS BECAUSE OF TRAFFIC CONDITIONS OR MECHANICAL
DIFFICULTIES OVER WHICH THE OPERATOR HAS NO CON-
TROL;
