Article 17 of the Code of Public Local Laws of Maryland, title
"Prince George's County," subtitle "County Commissioners," sub-
heading "Transfer Tax" be and the same is hereby repealed and
re-enacted with amendments to read as follows:

18-5. Transfer Tax.

(a) Imposed; rate. The [county commissioners] county council
of Prince George's County are hereby authorized and empowered to
impose a tax, [the proceeds to be used exclusively for school construc-
tion,] at [the] a rate [of two-fifths of] not to exceed, one per
centum of the actual consideration paid or to be paid under every
instrument of writing conveying title to real property, or any interest
therein, in Prince George's County, offered for record and recorded
in said county, provided that conveyances to the state or any agency
thereof or any political subdivision of the state, shall not be subject
to the tax imposed by this section. The term "instrument of writing"
shall include deeds, mortgages, deeds of trust, leases, contracts and
agreements, but shall not include purchase money mortgages, pur-
chase money deeds of trust, assignments of mortgages or releases,
provided, however, upon any refinancing of property, by the original
mortgagor or mortgagors the tax shall apply only to the consideration
over and above the amount of the original mortgage or deed of trust.

Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1971.

CHAPTER 606
(House Bill 1224)

AN ACT to add new Section 9B(c) to Article 25 of the Annotated
Code of Maryland (1970 Supplement), title "County Com-
missioners," subtitle "General Provisions," to follow immediately
after Section 9B(b) thereof, authorizing the County Commis-
sioners of Calvert County to transfer or lease certain property to
the Calvert County Historical Society, Incorporated, without com-
plying with certain provisions of Section 9B.

Section 1. Be it enacted by the General Assembly of Maryland,
That new Section 9B(c) be and it is hereby added to Article 25 of
the Annotated Code of Maryland (1970 Supplement), title "County
Commissioners," subtitle "General Provisions," to follow immediately
after Section 9B (b) thereof, and to read as follows:

9B.

(c) The County Commissioners of Calvert County may transfer,
convey, or lease to the Calvert County Historical Society, Incorpo-
rated, the land and improvement known as Solomons Elementary
School property, or any part thereof, for use as a public maritime
museum without complying with the requirements of this Section,
