H. Producer. Any person who controls one or more cows, from
which a part or all of the milk is sold or offered for sale to a milk
plant, receiving station, or transfer station.
I. Distributor. Any person who offers for sale or sells to another
any pasteurized milk products.
J. Producer-Distributor. Any person who produces and distrib-
utes at retail his own raw milk products.
K. Processor. Any person who owns, operates or controls a milk
plant.
L. Bobtailer. Any person who operates or controls a milk route
and distributes pasteurized milk products which he purchases from
a processor.
M. Secretary. The Secretary of Health and Mental Hygiene, or
his designee.
N. Milk Truck Tank. A tank and its equipment used to transport
milk.
0. Milk Truck Tank Operator. Any person in charge of a milk
truck tank while it is receiving, transporting, or delivering producer
milk or producer milk samples.
P. Adulterated Milk Products. Any milk product shall be deemed
to be adulterated (1) if it bears or contains any poisonous or dele-
terious substance in a quantity which may render it injurious to
health; (2) if it bears or contains any added poisonous or deleterious
substance for which no safe tolerance has been established by State
or Federal regulation, or in excess of such tolerance if one has been
established; (3) if it consists, in whole or in part, of any foreign
substance unfit for human consumption; (4) if it has been pro-
duced, processed, prepared, packed, or held under insanitary con-
ditions; (5) if its container is composed, in whole or in part, of any
poisonous or deleterious substance which may render the contents
injurious to health; or (6) if any substance has been added thereto
or mixed or packed therewith so as to increase its bulk or weight,
or reduce its quality or strength, or make it appear better or of
greater value than it is.
Q. Misbranded Milk Products. Milk products are misbranded (1)
when the container(s) bear or accompany any false or misleading
written, printed or graphic matter; (2) when such milk products
do not conform to their definitions as contained in this law or regu-
lation; and (3) when such products are not labeled in accordance
with this law or regulation.
R. Pasteurization. The terms "pasteurization," "pasteurized,"
and similar terms shall mean the process of uniformly heating every
particle of milk product, holding in the heated state and cooling; in
approved and properly operated equipment and under such condi-
tions of temperature and time as the Secretary shall establish by
regulation to render milk products safe and free of pathogens. Noth-
ing in this definition shall be construed as barring any other proc-
ess which has been recognized by the appropriate Federal Author-
ity to be equally efficient in rendering milk products safe and free
of pathogens provided such process is approved by the Secretary.
