lic Local Laws of Maryland), title "Frederick County," subtitle
"Part I. General Local Laws," subheading "Metropolitan Commis-
sion," and to add new Section 10A-26 to said Code, title, subtitle
and subheading, to follow immediately after Section 10A-25 there-
of, to authorize the County Commissioners of Frederick County to
appoint alternate ADDITIONAL members to the Metropolitan
Commission, provide for their compensation, powers and duties. ,
and to require approval by the County Commissioners of actions
of the Commission before the actions become final.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 10A-1 (a) of the Code of Public Local Laws of
Frederick County (1959 Edition and Supplements thereto, being
Article 11 of the Code of Public Local Laws of Maryland), title
"Frederick County," subtitle "Part I. General Local Laws," subhead-
ing "Metropolitan Commission," be and it is hereby repealed and re-
enacted, with amendments; and that new Section 10A-26 be and it is
hereby added to said Code, title, subtitle and subheading, to follow
immediately after Section 10A-25 thereof, and all to read as follows:

(a) For the purpose of carrying out the provisions of this chap-
ter, the sanitary district created hereafter is under the jurisdiction
of a commission of throe FIVE persons, all of whom shall be ap-
pointed by the county commissioners of Frederick County, and all of
whom shall reside in Frederick County, be resident taxpayers of said
county and qualified voters thereof. The members of the commission
shall receive such compensation as may be determined by the county
commissioners from time to time. The term of each of the throe
FIVE members is five years or until their successors are appointed
and have qualified, except that the first commissioner named by said
commissioners shall serve for one year, the second shall serve for
two years, and the third shall serve for three years, THE FOURTH
SHALL SERVE FOR FOUR YEARS, AND THE FIFTH SHALL
SERVE FOR FIVE YEARS, from the dates of their respective
appointments; and as the term of each commissioner expires, his
successor shall be appointed by the county commissioners. The com-
mission shall name its chairman and vice-chairman. Any vacancy in
the membership of the commission shall be filled by appointment by
the county commissioners for the unexpired term. The County Com-
missioners shall also appoint two alternate members to serve five
year terms or until their successors are appointed and qualified.
They shall receive compensation as provided by the County Commis-
sioners. Either or both of the alternate members may sit as regular
members in the absence of one or more of the regular members as
directed by the County Commissioners and only while so sitting shall
have the same powers and duties of the regular members. The mem-
bers of the commission are a body corporate by the name of the
"Frederick County Metropolitan Commission" (referred to elsewhere
in this chapter as "the commission"), with the right to use a common
seal, to sue and be sued, and to do any and all other corporate acts
for the purpose of carrying out the provisions of this subheading.
Nothing in this section shall be construed to affect the rights and
liabilities of the Commission; and as reconstituted, the continuity
of the Commission's legal existence shall not be impaired.
