423) To which same with the same Joshua did appear in person and vouched the Common Vouchee to warrant the premisses so demanded who appeared and Entered into warranty of the same and afterwards made default so that a Common Recovery of the premisses with the appurtenances was had and perfected according to the usual Course of Common Recoveries for docking & barring Estates Tail as by the Record and process thereof now remaining in the said Provincial Court at the City of Annapolis may more fully appear Now this Indenture Witnesseth that it Covenanted granted and agreed between the partys af.d and the said Joshua George doth hereby also Signify and Declare that it now is and at the time of suffering the Recovery af.d was and was declared to be that after the same Recovery had and perfected the same Recovery and the Execution thereof should be and enure and should be taken deemed and Construed to be and Enure to the proper use and behooffe of him the said John Ward his heirs and assigns for ever and that the same John Ward the Recoveror thereof and his heirs and assigns for ever Should from thence forth stand be Seized of the Land af.d with the appurtenances to his and their own proper use and behooffe for ever And the said Joshua George for himself and his heirs doth hereby remise release and for ever quit Claim unto the said John Ward in his peaceable and Quiet Seisin thereof now being the recovered Premisses with the appurtenances To have & to hold the said Recovered premisses with the Appurtenances to the said John Ward his heirs and assigns to the only proper use and Behooffe of the said John Ward his heirs and Assigns for ever I witness whereof the parties to these presents have thereunto interchangeably set hands and seals the Day and year first above written Sealed and Delivered In presence of Joshua George seal R.d Tilghman John Cox |
