88) Aug.t 20 1750 Reced five Shillings Sterling for an Alienation fine on the within Land By Recorded Sept.r 29.th 1750 Tho Gillis Rec.r Ex.d This Indenture Tripartite made the thirteenth Day of August in the Year of our Lord Seventeen hundred and fifty Between William Stevens of Talbot County Planter of the first part Thomas Stevens of the same County Planter of the Second part and John Barnett of the same County Planter of the third part Witnesseth that the said William Stevens for the Docking Barring and Cutting off all Estates tail and Reminders in Tail of and in the Messuage Tenements Lands and Hereditaments herein after mentioned and for the Settling and Assuring of the same to and for the Uses Intents and Purposes herein after limitted expressed and Declared and in Consideration of five Shillings Money to him in hand paid by the said Thomas Stevens the Receipt whereof is hereby Acknowledged and for divers other good Causes and Considerations him the said William in this behalf moving Hath Granted Bargained and Sold released and Confirmed and by these Presents Doth Grant Bargain and Sell release and Confirm unto the said Thomas Stevens his Heirs and Assigns forever All that part of Tract or Parcel of Plantable Land lying in the County afsd called Catlins Plains which is contained within the following lines to wit Beginning at the Second Tree of the said Tract called Catlins Plains and running from thence South East by East two hundred and thirty six Perches then North thirty Degrees Easterly Sixty Seven Perches then North fifty two Degrees Westerly one hundred and fifty Six Perches then North fourteen Degrees Westerly twenty Seven Perches and then with a Streight line to the said Beginning containing by Estimation one hundred Acres be the same more or less Together with all Edifices Buildings Improvements and Appurtenances to the said parcel of Land belonging or in any wise appertaining or in or upon the same growing happening or arising And the Reversions Remainders Rents and Services thereof or Incident thereunto To have and to hold the said parcel of Land and Premisses and every part and parcel thereof with the Appurtenances unto the said Thomas Stevens and his Heirs and Assigns forever To the Intent and purpose only that the said Thomas Stevens shall and may become perfect Tenant of the Freehold of the said Land and Premisses and shall and may stand and be duly had Suffered and Executed of the said parcel of Land and Premisses according to the Usual Course of Common Recoverys for the Assurance of Lands and Tenements in such Cases Used & Accustomed And thereupon it is Covenanted Concluded and Agreed by and between all the said partys to these Presents for themselves and their and every of their Heirs by these Presents in manner following (That is to say) That the said Thomas Stevens shall and will before the end of September Term next coming permit and suffer the said John Barnett to Sue forth and Prosecute against him the said Thomas Stevens one Writ of Entry sur Disseisin en le post returnable before his Lordships Justices of the Provincial Court at the City of Annapolis thereby demanding against the said Thomas Stevens the said parcel of Land and Premisses herein before mentioned by such Name and Names Number of Acres Quantities Qualitys Terms and Descriptions in the said Writ to be Contained and in such manner and form as by Counsel learned in the Law shall be Advised; Unto and upon which said Writ of Entry so to be Prosecuted and Sued forth the said Thomas ^Stevens^ shall appear Gratis and Vouch to Warranty the said William Stevens which said William Stevens shall appear either in Person or by Attorney Lawfully (Authorized) |
