80) August the 28.th 1750 Then came Charles Grahame one of the Subscribing Witnesses to the within Power of Attorney and made Oath on the Holy Evangelists of Almighty God That he saw Silvanus Grove 8 Sign Seal and deliver the same as his Act and Deed and that at the same time he said Jern Bigg Sign his Name as a Witness thereto Sworn before John Hepburn Recorded September 13.th 1750 Ex.d Maryland to wit This Indenture made this twenty ninth Day of August in the Year of our Lord one Thousand Seven hundred and fifty Between Roger Smith of Charles County in the Province of Maryland Planter and Mary his Wife of the one part and Richard Brooke of Saint Marys County in the Province afs.d Planter of the other part Witnesseth that the said Roger Smith and Mary his Wife, for and in Consideration of the Sum of five Shillings Current Money by the said Richard to them in hand paid at or before the ensealing and delivery of these Presents the Receipt whereof they do hereby Acknowledge and thereof and therefrom do hereby release Acquit and Discharge the said Richard Brooke his Executors and Administrators Have Granted Bargained and Sold and by these Presents Do Grant Bargain and Sell unto the said Richard Brooke his Executors Administrators and Assigns All that Tract or Parcel of Plantable Land Situate lying and being in Saint Mary's County afsd called Notley's Addition containing four hundred and fifty Acres of Land more or less And the Reversion and Reversions Remainder and Remainders Rents Issues and Profits thereof ^and of every Part thereof^ To have and to hold the said Land and Premisses with the Appurtenances unto the said Richard Brooke his Executors Administrators and Assigns from the day next before the day of the date of these Presents for and during and unto the full end and Term of one whole Year from thence next ensuing and fully to be Compleat and ended To the Intent and Purpose that the said Richard Brooke may be in the Actual Possession of the said hereby Bargained and Sold Land and Premisses with the Appurtenances and may hereby and by Force and Virtue of the Statute for Transferring Uses into Possession in that behalf made and Provided be Enabled to take a Grant and Release of the Reversion and Inheritance of the said Land and Premisses hereby Bargained and Sold or Intended so to be with the Appurtenances to him and his Heirs to such Uses and Purposes as shall be thereby declared In Witness whereof the said parties to these Presents have hereunto Interchangeably set their hands and Seals the day and Year first above Written Seal'd and Delivered Roger Smith Seal in the Presence of Mary Smith Seal Collin Mitchell Rich.d Brooke Seal Rob.t Whythell On the back of the aforegoing Lease was thus Endorsed (Viz.t) August 29 1750 Then reced of the within Named Richard Brooke the Sum of five Shillings Currency Current Money being the Consideration within mentioned As Witness our hands the day £ 0 5 0 and Year aforesaid Witness Collin Mitchell Rob.t Whithell Roger Smith Mary Smith Maryland Charles County to wit August 29.th 1750 Then came before me the Subscriber one of his 6 1/2 Lordships the Lord Proprietarys Justices of the Provincial Court of the Province of Maryland aforesaid the within parties who severally Acknowledged the within as their Act and Deed for the Uses Intents and Purposes therein mention'd & declared, At the same time came also Mary within mentioned Wife to the within Named Roger Smith who being by me privately and apart from her said Husband Examined Acknowledged the within as her Act and Deed freely Willingly and of her own accord without being forced or Induced thereto by her said Husband or through fear of his Displeasure (Taken) |
