504) several Tracts or Parcels of land to be equally divided between them the said John and Edward Talbott and for as much as both the said Sons John Talbott and Edward Talbott are willing and desirous that the Survivor or over liver of them shall not at any Time hereafter take any Comodity or Advantage of the Premisses or any Part or Parcel of them by Way of Survivor or over liver according to the Course and Order of the Common Laws of the Kingdom of England by Reason of that joint Title Estate and Interest which they have in and to the Premisses by Virtue of the Device afd Now the said John Talbott and Edward Talbott by the Advice of Honest Friends and with their full and whole Consent and Agreement have made Division and Partition between them of the said Parcels of Land and other Premisses thereunto belonging in Manner and Form following (Viz.t) that the said Edward Talbott shall have for his Moiety or Half Part of the aforesaid Devised Tracts or Parcels of Land as now divided between them by their full Consent and Agreement the said Edward Talbott to have all that Tract or Parcel of Land lying and being in Baltimore County aforesaid and on the West side of the Great Falls of Gunpowder River called Barrets Delight containing by Patent Two hundred Acres also another Tract of Land thereto adjoining called Barret's Addition containing by Patent One hundred and ninety Acres in all Three hundred and ninety Acres of Lands and Premisses thereunto belonging or in any wise appertaining and to be for ever hereafter reputed and taken by the said Edward Talbott his heirs and Assigns for ever as his and their prop Part and Portion of the Device aforesaid And that the said John Talbott shall have all the other Lands lying on the Drafts of West River in Ann Arundel County in the Province aforesaid with the Premisses and Appurtenances thereunto belonging or in any wise appertaining and to be for ever hereafter reputed and taken by the said John Talbott his Heirs & Assigns for ever as his and their Part and Portion of the Device aforesaid To have and to hold to the said Edward Talbott and John Talbott the aforesaid Parcels of Land as before expressed with the Appurtenances severally to them the said Edward Talbott and John Talbott severally their Heirs and Assigns for ever And for the true Meaning Performance and Keeping of all and singular the said Portions Covenants Conditions Agreements and Articles either Party bindeth himself his Heirs Exors and Adm.rs to the other by these Presents in the Sum of Five thousand Pound Sterling Money of England In Witness whereof the Parties to these Presents have interchangeably set to their Hands and Affixt their Seals the Day and Year first above written John Talbott Seal Sealed and Acknowledged in the Presence of Geo Steuart Charles Grahame Edward Talbott Seal On the Back of the aforegoing Deed was thus endorsed Viz.t On the 4.th Day of October 1754 Came John and Edward Talbott Parties to the within Deed and acknowledged the same before me (the) |
