496) same County and Province aforesaid Cordwainer of the other Part Witnesseth that the said Henry and Lucretia for and in Consideration of the Sum of three Thousand Pounds of Tobacco to them in Hand paid ^at or^ before the Ensealing and Delivery of these Presents the Receipt whereof is hereby acknowledged and the said Anthony Roberts his Executors and Administrators thereof and therefrom by these Presents fully acquitted and discharged and for the docking barring and extinguishing all Estates Taile and all Reversions and Remainders thereupon expectant or depending of and in the Lands and Tenements herein after released and confirmed or mentioned or intended so to be Have and each of them Hath remised released enfeoffed and confirmed Do and each of them Doth remise release enfeoff and confirm unto him the said Anthony Roberts (in his actual Possession now being by Virtue of a Bargain and Sale to him thereof made by them the said Henry and Lucretia bearing Date the Day next before the Day of the Date of these Presents for one Year commencing from the Day next before the Day of the Date thereof and by Force of the Statute for transferring Uses into Possession) his Heirs and Assigns All those two Tracts or Parcels of Land scituate lying and being in Saint Marys County aforesaid the one called S.t Williams Hermitage containing Two hundred Acres of Land more or less the other called Twithenham containing Three hundred Acres of Land more or less (except one hundred Acres formerly sold unto a certain William Howard and also one hundred and seventy Acres formerly sold unto a certain Walter Davis) and the Reversion and Reversions Remainder and Remainders Rents Issues and Profits thereof and of every Part and Parcel thereof together with all and singular the Houses Edifices Buildings Improvements Profits Commodities and Advantages to the hereby released and confirmed Premisses belonging or in any wise appertaining and all the Estate Right Title Interest Use Trust Property Claim and Demand whatsoever of them the said Henry and Lucretia of into or out of the same and of every Part and Parcel thereof To have and to hold the said two Tracts of Land hereby released and confirmed or intended so to be (except as before is excepted) unto him the said Anthony Roberts his Heirs and Assigns for ever to the Intent and Purpose that the said Anthony Roberts may be perfect Tenant of the Freehold of the said Premisses hereby released and confirmed with the Appurtenances that a common Recovery may be had and suffered ^against him^ by the said Anthony Roberts at the next ensuing or some other subsequent Provincial Term And it is hereby declared by and between the said Parties to these Presents that whatsoever common Recovery or Recoverys of the said Premisses hereby released and confirmed or intended so to be is are or shall be had and suffered during the Provincial Term aforesaid or any subsequent Provincial Term shall be deemed construed and taken to be and enure to and for the Use and Behoof of him the said Anthony Roberts his Heirs and Assigns for ever and to or ^or^ for no other Use Intent or Purpose whatsoever In Witness whereof the Parties to these Presents have hereunto set their Hands and Seals the Day and Year first above written |
