448) Vide Mortgage to which the following Assignment belongs Recorded in this Book folio 343 Ex.d Know all Men by these Presents That I John Brice of the City of Annapolis Esq for and in Consideration of the Sum of Seventeen Pounds and four Pence half Penny Sterling and thirty six Pounds six Shillings Curr.y to me in hand paid by Charles Carroll of the City of Annapolis Esq the same being a Debt due to me from Philip Edwards of Baltimore County Planter the Receipt whereof I do hereby Acknowledge Have Assigned Transferred and made over and by these Presents Do hereby Assign Transfer and make over unto him the said Charles Carroll his Heirs and Assigns for ever All my Right Title Interest Property Claim and Demand of which Nature or kind so ever either in Law or in Equity of in or to a Mortgage made by the said Philip Edwards to me bearing Date the Tenth day of April One Thousand seven hundred and fifty three duly Executed Acknowledged and Recorded in the Provincial Records Lib E I N.o 12 folio's 343 344 & 345 may more fully and at large appear Together with the several Tracts of Lands and Chattels in the said Mortgage mentioned and every part and parcel thereof with their Appurtenances To have and to hold the several Tracts and Parcels of Land and Chattels in the Annexed Mortgage mentioned and every part and Parcel thereof with their Appurtenances unto him the said Charles Carroll his Heirs and Assigns for ever to his and their only proper Use and Behoof and to and for no other Use Intent or Purpose whatsoever Provided always and it is the true intent and meaning of these Presents and the Parties thereto That I the said John Brice my Heirs Exors or Adm.rs shall nor will not be Answerable to the said Charles Carroll his Heirs Exors Adm.rs or Assigns for the Consideration Money above mentioned nor for any Costs or Charges that shall or may arise or accrue due to any Person or Persons whatsoever by means of the above Assignment in the Prosecution of any Suit or Suits thereon whether it be by foreclosure of the Annexed Mortgage in Equity or in any Suit or Suits which shall or may be commenced on any of the Covenants in the Annexed Mortgage mentioned or by any other ways or means whatsoever But that I the said John Brice my Heirs Exors or Adm.rs shall be therefrom for ever wholly Acquit and Discharged In Witness whereof the said John Brice hath hereunto set his hand and Affixed his Seal this nineteenth day of January One Thousand seven hundred and fifty four Jn.o Brice Seal (Signed) |
