411) whatsoever unto the said William Beck his Heirs and Assigns for ever be the same by Fine or Fines common Recovery or Recoverys Deed or Deeds Inrolled or not Inrolled or by any other ways or means whatsoever as by the said William Beck his Heirs or Assigns or his or their Council learned in the Law shall be devised or required so as in such further Conveyance there be not contained any further or other Warranty than is herein Contained In Witness whereof the said Parties to these Presents have hereunto Interchangeably set their hands and Seals the Day and Year first above Written Luke Philbert Seal Sealed and Delivered in the Presence of Will.m Beck Seal Sam Young Fran.s Parnham Seal Rich.d Lake On the back of the aforegoing Deed was thus Endorsed Viz.t Reced the Day and Year first within mentioned of and from the within named William Beck the Sum of Nine Thousand Pounds of Tobacco being the Consideration within mentioned Witnesses 14 Recorded Sept.r 26.th 1753 Ex.d Maryland fs.t This Indenture made this Twenty eighth day of September in the Year of our Lord Seventeen hundred and fifty three Between William Cumming of Frederick County and Province af.d Gentleman of the one part and Charles Grahame of Calvert County and John Cooke Esq.r of Prince Georges County both of the Province af.d of the other part Witnesseth that Whereas William Cumming stands Justly Indebted unto John Wardrop and Charles Grahame in Company Merchants in Calvert County by Bond in the Penal Sum of four hundred ninety seven Pound one Shilling and nine Pence Sterling Money of Great Britain in which Bond the said William Cumming is Nominated and Called William Cumming Jun.r Jointly and severally with William Cumming Esq.r of the City of Annapolis now deceased as by the said Bond dated the fourth day of March in the Year of our Lord Seventeen hundred and fifty referrence being thereunto had may more fully appear for the Recovery of which said Debt due as aforesaid the said John Wardrop and Charles Grahame have brought their Action in the Provincial against the ^first^ said William Cumming above mentioned as by referrence being had to the Proceedings of the said Court may more fully appear And Whereas the said William Cumming is willing and desirous to secure the Payment of the afsd Debt together with the Interest which is now due and shall become due thereon in the best manner he can and Whereas the said John Wardrop and Charles Grahame have Agreed to and with the said William Cumming upon his the said William Cumming's (Assuring) |
