354) on the Point of a Hamock where a Sloop was formerly Built by a Creek side known by the Name of Ease Creek being the first Bounder of the Tract of Land above mentioned called Scots Folley and also the first Bounder of a Tract of Land formerly Surveyed for the said Whittington called Goshan thence up and with the Westermost side of the said Ease Creek to the Mouth of a small Creek or Gut Issuing out of the main Creek into the Ponds dividing from the Land formerly of one Randal Long thence along and with the said Gut and Ponds and and bounding thereby to the first Beginning Containing One hundred and forty Acres of Land be the same more or less Together with all Messuages Buildings Improvements Profits Previledges Hereditaments and Appurtenances unto the afsd One hundred and forty Acres of Land called Canaan belonging or in any wise ^manner^ appertaining and the Reversions and Remainders Rents Issues and Profits thereof or incident thereto To have and to hold the aforesaid One hundred and forty Acres of Land with the Messuages Tenements and Premisses above mentioned and every part and Parcel thereof with the Appurtenances unto the said Stephen Horsey and his Heirs forever To the Intent and Purpose only that the said Stephen Horsey shall and may become perfect Tenant of the Freehold of the said Messuages One hundred & forty Acres of Land Tenements and Premisses and shall and may stand and be Seized thereof until a good and perfect Common Recovery with Double Vouchers over may be duly had Suffered and Executed of the said Messuages Tenements Lands and Premisses according to the usual Course of Common Recoverys for Assurance of Lands and Tenements in such Cases Used and Accustomed And thereupon it is Covenanted Concluded and Agreed by and between all the said Parties to these Presents for themselves and their and every of their Heirs by these Presents in manner following that is to say that the said Stephen Horsey shall and will permit and suffer the said Southy Whittington before the end of April Term next coming to Sue forth and Prosecute against him the said Stephen Horsey one Writ of Entry sur Disseisin en le Post returnable before his Lordships Justices of the Provincial Court at the City of Annapolis thereby demanding against the said Stephen Horsey the said Messuages Tenements Lands Hereditaments and Premisses herein before mentioned by such Name and Names Number of Acres Quantities Qualities Terms and Discriptions in the said Writ to be Contained and in such manner and form as by Councel learned in the Law shall ^be^ Advised unto and upon which said Writ of Entry so to be Prosecuted and sued forth the said Stephen Horsey shall appear Gratis and Vouch to Warranty the said Joshua Atkinson and Elizabeth his Wife and the said James Atkinson which said Joshua Atkinson and Elizabeth his Wife and the said James Atkinson shall appear either in Person or by Attorney Lawfully Authorized and (enter) |
