327) Ex.d This Indenture made the sixteenth day of November Anno Domini One Thousand Seven hundred and fifty two Between John Digges of Conniwago of the one part & Edward Digges of Charles County William Digges of Prince Georges County Elizabeth Neale & Elenor Fancy of S.t Marys County of the other part Witnesseth that the said John Digges for and in Consideration of the Natural Love and Affection which he hath and beareth to the said Edward Digges William Digges Elizabeth Neale & Elianor Fancy and for divers good Causes and Considerations and five Shillings Sterling to him in hand paid by the Parties above mentioned him thereunto moving Hath Given Granted Aliened and Confirmed and by these Presents Doth fully and Absolutely Give Grant Alien and Confirm to the said Edward Digges William Digges Elizabeth Neale and Elenor Fancy their Heirs and Assigns for ever All the Right Title Property and Interest whatsoever which he the said John Digges hath of in & unto all that Tract of Land called Barbadoes or Durham lying in Charles County on the East side of the Fresh Run of Portobacco Creek Computed to be & Contain One Thousand Acres more or less To have and to hold all & singular the said Tract or Parcel of Land Called Barbadoes or Durham with the ^Premisses &^ Appurtenances unto the said Edward Digges William Digges, Elizabeth Neale & Elenor Fancy their hrs and Assigns for ever & to no other Use Intent or Purpose whatsoever so that neither he the said John Digges his Heirs nor Assigns nor any of them nor any Person or Persons whatsoever Claiming or to Claim by from or under him or them him or any of them shall or will hereafter Claim or Demand any Right Title Interest or Estate of in or to the said Land & Premisses or to any part thereof But from all and every Action Right Title Estate Claim Property or Demand whatsoever of it & to the same he the said John Digges and his hrs and every of them shall be utterly excluded and Debarred for ever by these Presents In Confirmation whereof the Parties to these Presents first above mentioned have hereunto Interchangeably set their hands & seals the day and Year first above Written Signed Sealed & Delivered John Digges Seal In the Presence of John Darnall William Darnall On the Back of the aforegoing Deed was thus Endorsed Viz.t Nov.r the 16.th 1752 Came M.r John Digges party to the within before me the Subscriber one of his Lordships Justices of the Provincial Court and Acknowledged the within Deed according to Law John Darnall Reced five Shillings Sterling the Consideration Money within expressed Nov.r 16.th 1752 John Digges Testis John Darnall Dec.r 13.th 1752 I have Received of M.r W.m Digges for the Use of the Right Honble the Lord Baltimore forty Shillings Sterling being for the Alienation Fine of the within One Thousand Acres of Land Benj.a Tasker Recorded December 13.th 1752 5 sides |
