148) July the 1.st 1751 Received of Benedict Calvert Esquire five Shillings Sterling in lieu of a Barrell of Corn the Alienation fine on the Lands called his Lordships Kindness and two Pounds eighteen shillings Shillings Sterling for the Alienation fine on the Lands called Several Tracts for the Use of the Right Honourable the Lord Baltimore By Virtue of a Commission from Benjamin Tasker Esq.r his said Lordships Agent and Receiver General Rich.d Dorsey Recorded July 1.st 1751 14 Ex.d On the Second day of April One Thousand Seven hundred and fifty one Before me Gyles Lone Notary Publick Sworn and Admitted dwelling in London Personally appeared William Tower of Limehouse in the County of Middlesex Merchant Bartholomew Pomeroy of Leadenhall Street London Linnen Draper and Joseph Janson of London Merchant Assignees appointed under a Commission of Bankruptcy some time since awarded & Issued against John Philpot of Mile End in the County of Middlesex and John Hutchinson late of Plaistow in the County of Essex Merchants and Partners and Declared to have made Ordained Constituted and Appointed ^and by these Presents do make Ordain constitute and appoint^ Brian Philpot the Younger of the Province of Maryland Merchant and in Case of his Decease or Absence Joseph Taylor and John Gassaway of the Province aforesaid Merchants jointly and severally their true and lawfull Attorneys Giving and by these Presents Granting unto their said Attorney or Attorneys full Power and Lawfull Authority for them the said Constituents in their Names and on their behalfs To Ask Demand and receive of and from all and every Person or Persons whom it doth or may Concern (residing in the Province of Maryland aforesaid all such Sum and Sums of Money Goods Wares Merchandizes Effects Estate and things whatsoever which he they or any of them now have or may hereafter have in his their or any of their hands Custody or Possession due owing Payable or belonging to the Estate of the said John Philpot and John Hutchinson whether by Bond Note Bill Book Debt Account Consignment or otherwise howsoever nothing excepted or reserved And for the Purposes (afsd) to Account and to View State Settle and Adjust all Accounts and the Ballance or Ballances to receive upon receipts to give one or more Acquittance or Acquittances or other Sufficient discharges in due form of Law But in Case of Refusal or delay by any Person or Persons whom it doth or may Concern do make and render Just and true Account Payment and Satisfaction in the Premisses him them and every of them thereunto to Compell and for that Purpose to Commence one or more Suit or Suits at Law or in Equity and the same to Prosecute to a finall Determination Also if need be to Compound Compromize Conclude and Agree by Arbitration or otherwise And Generally in the Premisses to perform Transact and Accomplish (and) |
