136) Ex.d This Indenture made this Sixth day of June in the Year of our Lord One Thousand Seven hundred and fifty one Between George Atkinson of the City of Annapolis Merchant Surviving Executor of the last Will and Testament of Christopher Grindall late of London Mariner deceased and Thomas Sligh of Baltimore County in the Province of Maryland Merchant of the other part Whereas in September Term in the Year of our Lord Seventeen hundred and fifty he the said George Atkinson as Surviving Executor as afd Obtained four Judgments of four hundred and thirty Six Pounds fourteen Shillings and ten pence Sterling Money besides the several Costs of Suit in the Provincial Court against Henry Morgan, Thomas Sheredine, Thomas Sligh and William Barney of Baltimore County in the Province of Maryland afs.d relation being thereunto had more at large it doth and may appear Now this Indenture Witnesseth That for and in Consideration of the Sum of Two hundred and fifty Pounds four Shillings and six pence Sterling and all the Costs of Suit in the Actions afs.d to the said George Atkinson Surviving Executor as afd and a certain James Slemaker the other Exor now deceased by the said Thomas Sligh in hand paid the Receipt whereof is hereby Acknowledged he the said George Atkinson Hath Assigned Transferred and sett over and by these Presents Doth Assign Transfer and set over unto the said Thomas Sligh his Executors Administrators and Assigns as well the said Judgments of four hundred and thirty six Pounds fourteen Shillings and ten pence Sterling and all Costs of Suit and all Benifit and Advantage of the said Judgments or either of them and all the Right Title Interest Advantage Claim and Demand whatsoever of him the said George Atkinson Surviving Executor as afs.d And the said George Atkinson Surviving Exor as afd Doth hereby Constitute and Appoint the said Thomas Sligh to be his Lawfull Attorney in the Name of him the said George Atkinson Surviving Executor as afd but for the Use and benifit of the said Thomas Sligh his Exors Adm.rs and Assigns to Ask Demand Sue for Levy Recover and Receive Acquit Release and Discharge the Money and Costs of Suit afsd hereby Assigned and every or any part thereof and all Money and Costs due or to grow due upon the said Judgments and upon Receipt thereof to Cause Satisfaction to be Acknowledged upon the ^Records of the^ said Judgments or other proper discharge in the Name of the said George Atkinson Surviving Executor as afs.d to make and give And also in his Name to Commence Prosecute Perform and do all such further Acts matters and things relating to the Premisses as he shall think needfull and requisite the said Thomas Sligh his Executors Administrators and Assigns from time to time and at all times hereafter saving defending keeping harmless and indemnifying the said George Atkinson Sur Exor as afsd his Heirs Executors & Adm.rs and his and their Lands and Tenements Goods and Chattels of from and against all Costs Charges Damages and Expences which shall or may happen or accrue to him them or either of them for or by reason or means of this present Assignment or for or by reason or means of any Process that shall be sued out upon or by means of the said Judgments or either of them In Witness whereof the said George Atkinson Surviving Executor afs.d hath hereunto set his hand and seal the day and Year first above Written Geo Atkinson Seal (Sealed) |
