131) and Anna his Wife before me the Subscriber one of his Lordships Justices of the Peace for the Provincial Court and Acknowledged the above and within Indenture to be their Act and Deed and the Lands & Premisses therein mentioned to be the only Right of the within Named Richard Small and his Heirs for ever according to the form force and effect true Intent and meaning of the said Deed and I do further Certify that I Examined the said Anna Cole privately out of the hearing of her said Husband and she did declare and Assert that she made her said Acknowledgment willingly & freely without being Induced thereto by fear or threats of or Ill Usage from her said Husband or for fear of his Displeasure Acknowledged before Robert Gordon Recorded April 18.th 1751 6 1/2 Ex.d On the Back of a Patent to John Nevill for three hundred Acres of Land called ^the^ Huckle Berry Swamp lying in Charles County dated 8.th September 1664 was thus Endorsed Viz.t Know all Men by these Presents That I William Nevil of Charles County Planter Do Assigne all my right Titele and Intrust of this within peisid Patting from me my hares Exxotors Administrators and Assignes to M.r Thomas Mathews his Hayres Exxotors Administrators and Assignes for Evur as Wittnes my hand and sele this twenty thurd of November 1667 Signed Seled and Will.m Nevill seal Deliverd in P.rsents of Us The marke T of Thomas Allcott John Hitchinson 1 Recorded April 18.th 1751 Ex.d This Indenture made the Twenty fifth day of April in the Year of our Lord One Thousand Seven hundred and fifty and Between Charles Higgenbotham of Frederick County Farmer of the one part and His Excellency Samuel Ogle Esq.r of the other part Witnesseth That the said Charles Higgenbotham for and in Consideration of the Sum of two hundred and twenty Pounds of Lawfull Money of Great Britain to him in hand paid by the said Samuel Ogle at or before the Sealing and Delivery of this present Indenture the receipt whereof the said Charles Higgenbotham doth hereby Acknowledge and thereof and of every part and parcel thereof doth Clearly and Absolutely Acquit Exonerate and Discharge the said Samuel Ogle his Executors and Administrators for ever by these Presents hath Granted Bargained Sold Aliened Enfeoffed and Confirmed and by these Presents doth Grant Bargain Sell Alien Enfeoff and Confirm unto the said Samuel Ogle and his Heirs all that Tract or Parcel of Land called Charle Mount containing three hundred Acres of Land more or less lying and being formerly in Prince Georges County but now in Frederick County which said Tract of Parcel of Land was Granted by Patent of Confirmation bearing date the fourth day of December in the Year of our Lord One Thousand Seven hundred & forty Seven unto the said Charles Higgenbotham as by the said Patent referrence being thereunto had may more fully appear and all and Singular the Houses Buildings Orchards Fences and Meadows thereunto belonging and all the Right Estate Interest Claim and Demand whatsoever of him the said Charles Higgenbotham of in and to all and singular the Premisses and every part and parcel of them To have and to hold the said Land and Premisses herein before mentioned and intended to be hereby Granted with their and every of their Appurtenances unto the said Samuel Ogle ^his Heirs^ and Assigns for ever to the only proper Use and behoof of him the said Samuel Ogle his Heirs & Assigns forever And the said Charles Higgenbotham for himself and his Heirs Executors and Administrators the said Tract or Parcel of Land and all and singular other the Premisses with their and every of their Appurtenances unto him the (said) |
