110) Sealed and Delivered in the Presence of Geo Steuart Hen Woodward At the foot of the aforegoing Deed was thus Written Viz.t Came before me the Subscriber one of his Lordships Justices of the Provincial Court James Macdonald and Acknowledged the within Instrument as his Act and Deed and the Lands and Premisses within mentioned to be the Right and Estate of the said Edward Dorsey and his Heirs according to the Directions of the Act of Assembly in that Case made and provided Acknowledged before me this 25.th Day of January 1750 Geo Steuart January 25.th 1750 Received of M.r Edward Dorsey the Sums of Twenty eight Pounds Current Money and Seven Pounds four Shillings Sterling the Consideration Money within mentioned his James + Macdonald Witness H Woodward mark 7 Recorded January 28.th 1750 Ex.d This Indenture made the Thirtieth day of January in the Year of our Lord God One Thousand Seven hundred and fifty by and Between Daniel Dulany and Charles Carroll Esquires in Company in Iron Works of the one part and Charles Carroll of the City of Annapolis Surgeon on the other part Witnesseth That Whereas Daniel Dulany Esquire and Company in Iron Works had Granted unto them by Patent bearing date the thirtieth day of April in the Year of our Lord One Thousand Seven hundred and forty eight One hundred Acres of Land Scituate and being on Givins Falls in Baltimore County Beginning at the Southermost end of a large Rock near the afs.d Falls and on the North side thereof and Opposite to the Baltimore Iron Works Furnance and running thence North Seventy two Degrees and thirty Minutes West forty four Perches North thirty nine Degrees West Twelve Perches North Seventy six Degrees West eighteen Perches South fifty eight degrees and thirty Minutes West eighteen Perches West Twenty five Perches North twenty one Degrees West Thirty four Perches North fifty five Degrees and thirty Minutes East one hundred eighty five Perches South East Seventy five Perches South West Forty Perches and thence with a Streight line to the Beginning Containing One hundred Acres of Land more or less according to the Patent aforesaid Granted unto Daniel Dulany Esquire and Company in Iron Works according to Directions of an Act of Assembly of this Province And Whereas the said Charles Carroll Surgeon at his own Cost and Charges hath Built on the said hundred Acres of Land a Furnace for running Pigg Iron from the Ore with a Forge Mill and other Conveniencies agreeable to the said Act Now this Indenture further Witnesseth that the said Daniel Dulany and Charles Carroll Esquires for and in Consideration of the Sum of five Shillings Sterling Money of Great Britain to them in hand and for divers other good Causes and Considerations every one of them Hath for himself and no other Bargained Sold Released Quit Claim and Confirm and by these Presents Do Bargain Sell Release Quit Claim and Confirm unto ^him^ the said Charles Carroll Surgeon the Share and Proportion of every one of him of and to the said One hundred Acres of Land herein before described together with the Share and Proportion of every one of them All and Singular the Furnace Forge Mill and other Buildings Conveniencys and Improvements on the said hundred Acres of Land being belonging or Appertaining To have and to hold unto him the said Charles Carroll Surgeon his Heirs and Assigns for ever the said One hundred Acres of Land with the Appurtenances as well against every of them the said Daniel Dulany and Charles Carroll Esquires for the Share and Proportion of every one of them as against any other Person or Persons Claiming or to Claim such Share or Proportion under any one of them and not one for another And the said Charles Carroll Surgeon for himself his Heirs Executors Administrators and Assigns doth Covenant and Agree to and with the said Daniel Dulany and Charles Carroll Esquires that neither he the said Charles (Carroll) |
