Ex.d This Indenture made the Eleventh Day of May in the Year of our
       Lord Seventeen hundred & forty five Between Nathan Smith of
       North Carolina but now being in Calvert County Son & Heir apparent
       of Thomas Smith late of Prince Georges       but now
       of North Carolina & Elizabeth his Wife of the one part and John
       Hall of Lyons Creek in Calvert County Merchant of the other
       Part Witnesseth that for & in Consideration of the Sum of three
       Hundred Pounds Sterling to him the said Nathaniel Smith in hand
       paid by the said John Hall the receipt whereof is hereby acknowledged
       It is Covenanted Granted concluded & Agreed ^upon^ by & between
       the said Parties to these Presents that the said John Hall
       shall before the End of the next Provincial Court Purchase
       & sue forth at the Proper Cost & Charge of him the said John Hall one
       Original Writ of Entry Sur disseisin en le Post returnable before
       the Justices of the Same Court at Annapolis & shall thereby demand
       against the said Nathan Smith All that Plantation Tract or Parcell
       of Land lying & being at Lyons Creek on the East Side of
       Patuxent River within this Province of Maryland Containing
       by Estimation three hundred Acres & was formerly the Land
       of ^one^ Francis Leaf together with the Dwelling House & all other
       House or Houses Improvements & Appurtenances thereunto
       belonging by Such Name or Names Quantity or Number of
       Acres as the said John Hall or his Councill shall require unto
       Which Writ the said Nathan shall appear gratis & shall Vouch to
       Warranty the Common Vouchee who shall likewise appear
       gratis & enter into Warranty & Plead that Hugh Hunt did
       not disseise the said John Hall & put himself upon the Country
       Whereupon the said John Hall shall imparle & afterwards
       Come into Court & the Common Vouchee altho solemnly called
       shall not come but Depart in Contempt of the Court & make
