359) Depending of and in that Part of a tract or parcel of land called Strife lying and being in Charles County aforesaid now in the Possession of the same James Mudd being Begining at a Bounded Maple and Runing thence south south West Two hundred and seventy six Perches then East thirty two Perches then North twenty four Degrees East Two Hundred and sixty four Perches Then to the Begining Containing fifty Acres with the Appurtenan^ces^ thereto belonging or any way Appertaining and for and in Consideration of the sum of Eleven Thousand Pounds of goods Merchantable Tob.o to the said James Mudd in hand paid by the said Alexander Smith Hawkins before the Sealing and Delivery hereof the Receipt and Payment whereof the said James Mudd doth hereby Acknowledge and for divers other goods Causes and Conside^ra^tions then the said James Mudd & Mary his wife hereunto moving have Covenanted Granted Concluded and agreed by and between the said parties to these Psents and the said James Mudd for himself his heirs Executors and Administrators and for the said Mary his wife Doth Covenant Grant and Agree to and with the said Alexander Smith Hawkins his Heirs Executors and Adm.rs by these Presents that before the End of next October Term or some other ensuing Term at the Costs and Charges of the said James Mudd one or more Writ or Writs of Entry Sue Disseisin en le Post shall and may be brought commenced and Prosecuted out of his Lordships high Court of Chancery Returnable and to be Returned before his Lordships Justices of the Provincial Court at Annapolis in the name of the said Alexander Smith Hawkins as Plaintiff or Demandant against the s.d |
