166 as af.d of the Said lands and premisses the said recovery or recoverys Shall be and enure and shall be construed esteemed adjudged and taken to be and enure and are hereby declared to have been intended to be and enure that the Said John Hall and every other person who shall be Seized of the Premisses or any part thereof by Virtue of the said common recovery or recoverys shall Stand and be Seized thereof and of every part & parcell thereof with their and every of their appurtences to the only use and behoof of the Said John Hall his heirs and assigns and to no other use intent or purpose whatsoever And it ^is^ further Covenanted granted concluded and agreed that the said Thomas Smith and his heirs the said two Tracts of Land and all and Singular other the premisses with the appurtenances except fifty acres thereof part of the Tract of Land called the High Lands unto him the Said John Hall his heirs and assigns Shall & will warrant and Defend by these presents In Witness whereof the parties to these presents have ^hereunto^ interchangeably Set their hands and Seald the Day & year first above written Tho.s Smith Jun.r Seal Sealed & Delivered in presence of John Hall Lyons Creek Seal Dorsey his Thomas T Maynard Mark On the Back of the aforegoing Deed was thus Endorst Viz.t Received May 22.d 1746 from M.r John Hall the sum of two hundred Pounds Sterling for the consideration within mentioned Testis Tho.s Smith Jun.r John Darnall |
