143 by and between all and every of the said parties and the true intent and meaning of the parties to these presents is that from and immediately after the said common recovery or recoverys shall be and enure and shall be construed esteemed adjudged and taken to be and Enure and are hereby Declared to have been intended to be and enure that the said Ignatius Wheeler and all and every other person or persons which shall be seized of the said premisses or any part thereof by force and Virtue of the said common recovery or recoverys shall stand and by seized thereof and of every part and parcell thereof with its appurtenances to the only use and behoof of the said John Whettonhall his heirs and assigns and to no other use intent or purpose whatsoever In Witness whereof the Parties have hereunto set their hands and affixed their seals the Day and year first above written Sealed and Delivered Ignatius Wheeler seal in the presence of John Whetenhall seal John Darnall Monica Whetenhall seal Edw.d Neale On the back of the aforegoing Deed was thus Endorst Viz.t Maryland fs.t April 23.d 1746 then came Ignatius Wheeler and John Whettinghall and Monica his Wife parties within named before me one of his Lordships Justices of the Prov.l Court and acknowledged the within Instrument of writing to be their Act and Deed and to and for the uses intents and purposes Therein mentioned and at the same time the same Monica was privately Examined out of the hearing of her said husband and acknowledged that she did the same freely & willingly without the Compulsion of her said husband or fear of his Displeasure 6 recorded April 23.d 1746 B Young Vide recovery recorded in Lib N.o 10 fol 169 |
