(536) Danielis Phillipo duorum Executorum in Dicto testamento nonisuat Quibus Commissa firit Administratio omnium et Singulorum bearorum jurium et Creditorum dici Defuncnti Declaratione Sive affirmatione predict juxta Statutum Parliamentt in eâ parte Editum et provisum de bene et fideliter administrando eadem per dictos Executores prima facta (reservata potestate similem Commissionem faciendi Johannis Falconar file dicti defunctil et alteri Executori in dicto Testamento usiniuat urum venerite Eaudem petiturus) Cujus quidem Testamenti Tenor verus sequitur in his verbis et est Talis vizt I John Falconar of London Merchant do make and ordain this my last Will and Testament written with my own hand in Manner following that is to say First I Give and bequeath unto my well beloved Cousin David Barclay ^of London [illegible] Proper^ twenty Guineas Item I Give & bequeath unto my kind Friend Daniel Phillips the like Sum of twenty Guineas Item all the rest and residue of my Estate of whatsoever nature or kind both real and personall as well in possession as in reversion remainder or Expectancy (all such Debts as shall be justly owing by and from me at the time of my Decease to any person or persons whatsoever and also my Legacys aforesaid and Funeral Charges being first duely paid and satisfied) I Give and bequeath unto my four Children Shall Dye before this my last will shall take Effect my Will is that his her or their Share or part shall go to and I hereby give and bequeath the same unto him her or them that shall survive share and share alike I Do make declare Constitute and appoint my Eldest Son John and my Cousin David Barclay and my kind friend Daniel Phillips both beforementioned to be my full & sole Executors of this my last Will and Testament giving unto my said Executors full Power and Authority to Compound or take apart for the whole for any Debt or Debts that shall be Owing to me at my Decease by any person or persons whatsoever where and when they shall see a Necessity so to do the same to be done wholly at the Cost of my Estate & ^and^ my said Executors not to be accountable for any loss or Damage that my happen or accrue by Such Abatement or Compounding any Debt or part of Debt or Debts to or with any person or persons whatsoever And my Will further is And I do hereby declare that Each ^one^ of my Executors shall only be accountable for his own transaction and for what Money ^or^ asid Effects shall Come into his hands & not the one for the other And Lastly I revoke and make Void all and singular former Wills by me heretofore made or pretended to be made Declaring this to be my last Will and Testament In Witness whereof I have hereunto set my hand and seal this fourteenth Day of August in the Year one thousand seven hundred and Twenty Nine Jn.o Falconar Signed Sealed published and Declared by the said John Falconar (the Testator) as and for his last Will and Testament on the day of the Date hereof in the presence of us who subscribed our ^Names^ thereto in the presence of the said Testator Jeremiah Thomas And.w Jaffray In quorum omnium et Singulorum premissorum fidem et Testimonium (has) |
