(190) And for the Uses afores.d from time to time for ever Discharged Acquitted & Saved harmless off & from all Former bargains Sales leases charges & Incumbrances had made Done or Suffered by the s.d Charles Digges & Susanna Maria his wife Henry Darnall & Eliz.a his wife Francis Hall & Dorothy his wife or either of them Since the Death of the s.d Nicholas Lowe And Lastly the Parties afores.d for themselves & their heirs do Covenant Grant & Agree to & with every other Severally & their Several heirs (to the Intent that all Disputes & Controversies ^hereafter^ between them their heirs & Assignes may Intirely be Extinguisht & Taken Away) in Manner & form following (That is to Say) that if it Shall so Happen that any of the Parties afores.d Shall hereafter be evicted expelled or ejected (by any former Right) from any Part or the whole of their parts portions or Purparties of the Lands as are so allotted to any of them by the Partition & Allotment af.d that in Such Case no Contribution Shall be had or Pretended to be had either in Law or Equity by the Person or Persons so ejected his heirs or assigns from any of the ^other^ Parties their heirs Ex.rs or Adm.rs by that Such Party ejected & the Person or Persons Claiming under him Shall for ever by these Presents be Debarred & precluded off & from any remedy for the Same by any way whatsoever In Witness Whereof to this Indenture with the Said Edward Neale remaining the s.d Charles Digges & Susanna Maria his wife Henry Darnall & Elizabeth his wife and Francis Hall & Dorothy his (Wife) |
