(438) Course of the former Tract and runing East South
East fourty seven pches to abounded white Oak Then South Eighteen degrees West One hunderd and Thirty four pches to amark.t Poplar Then South West Seven degrees Westerly Nine perches to a double bounded poplar being abounded Tree of the aforsaid parcel of Land Then by a Straight Line to the first Tree Containing twenty One Acres more or less (Excepting only Such part of the Said two Tract of Land as was formerly adjudged by the Land Commissioners to be within the Lines of a Certain Tract of Land called Pagget now in the possession of W.m Lock Esq.r) Together with all and all manner of Houses Out Houses Trees Woods under woods Profits advantages Emoluments & Appurtenances whatsoever to the aforsaid two Tracts of Land belonging or appertaining and the Revercon & Revercons Remainder and Remainders Rents Issues and profits of all and Sigular the said pmisses and every part & pcell thereof To Have and To Hold the said two Tracts of Land & Assigns premisses with the Appurtenances unto the said Nathaniel Joseph and Ann their heirs and Assigns for ever more And the said Thomas Jones for himself his heirs Ex.rs and adm.rs and for every of them doth further Covenant promise and grant to & with the said Nathaniel Joseph & Ann their heirs and Assigns that he the said Thomas Jones his heirs Ex.rs and Adm.rs the aforsaid two Tracts of Land and Pmisses with the Appurtenances unto the said Nathaniel Joseph and Ann their heirs and Assigns against him the said Thomas Jones and his heirs and all and every other pson or psons what soever Shall and will for ever hereafter Warrant and defend In Wittness whereof the parties hereto have interchangeably their hands and seals the day and year first above writtness Sealed & Delivered In presence of Thomas Jones Seal Abr.r Johns Bennett Garrett On the back of the aforegoing Instrument was thus Written viz.t Memorandum That on the first day of September Ann Dom 1730 came before me the Subscriber one of his Lordships Justices of the Provincial Court the within named Thomas Jones and acknowledged the within written Indenture to be his let & Deed All The Same time came Mary the wife of the Said Thomas Jones and being Secret by examined out of the hearing of her husband did declare that she did of her own free and voluntary Will give up all her Right of Dower Claim & Interest in & to the within mentioned Land (and) |
