may be open for business in Montgomery and Prince George's
Counties.
Section 1. Be it enacted by the General Assembly of Maryland.
That new Section 325B be and it is hereby added to Article 43 of
the Annotated Code of Maryland (1969 Supplement), title "Health,"
subtitle "State Board of Barber Examiners," to follow immediately
after Section 325A thereof, and to read as follows:
325B.
(a) In Montgomery and Prince George's Counties barber shops
shall be permitted to be open for business not more than six (6)
days in any calendar week and only during the hours designated
by the Board of Barber Examiners.
(b) Within thirty (30) days after July 1, 1970, the Board shall
submit to each licensed barber operating in Montgomery or Prince
George's Counties a questionnaire to ascertain in writing his prof-
erence as to (1) the one day in seven (7) on which such establish-
ments shall be closed; and (2) the hours when such establishments
shall be opened and closed. Such questionnaire shall be returned to
the Board not later than the tenth day, whereupon the Board, after
examination of all such questionnaires, shall within twenty (20)
days thereafter, designate as the one day in seven on which such
establishments shall be closed that day which is shown by the ques-
tionnaires to be the preference of a majority of the licensed and oper-
ating barbers of the Prince George's and Montgomery Counties, but
nothing herein contained shall prevent any owner, operator, em-
ployee, or agent of said owner from opening and operating his
establishments on the day voted by the majority to close upon a
showing made to the Board that the designated closing day conflicts
with the tenets of his religion, but his establishment shall be closed
on the Sabbath of his particular religion. The same procedure shall
be followed and the Board shall make its determination in the
same manner as to the hours when such establishments shall be
opened and closed. The order of the Barber Board shall become
effective thirty (30) days after determination, and public notice
of the action posted in the offices of the Board and in every
establishment affected thereby.
