CHAPTER 321
(Senate Bill 871)

AN ACT to repeal and re-enact, with amendments, the following
provisions of the Annotated Code of Maryland: Section 321 of
Article 66½ of the Annotated Code of Maryland (1967 Replace-
ment Volume), title "Motor Vehicles," subtitle "Offenses and
Prosecutions"; Section 233 of Article 27 of the Annotated Code
of Maryland (1967 Replacement Volume), title and subtitle
"Crimes and Punishments," subheading "Fraud, Motor Fuels, Oils
and Lubricants"; Section 153 of Article 56 of the Annotated Code
of Maryland (1968 Replacement Volume), title "Licenses," subtitle
"Motor Vehicle Fuel Tax"; Section 429 of Article 81 of the An-
notated Code of Maryland (1969 Replacement Volume), title
"Revenue and Taxes," subtitle "Road Tax on Motor Carriers";
Section 66A of Article 89B of the Annotated Code of Maryland
(1969 Replacement Volume), title "State Roads," subtitle "Duties
and Powers," in order to provide that summonses may be issued
for certain violations of law, to wit, Article 27, Sections 231 and
232; Article 56, Sections 135 through 157; Article 81, Sections 422
and 423; and Article 89B, Section 66A of the Annotated Code of
Maryland.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 321 of Article 66½ of the Annotated Code of Maryland
(1967 Replacement Volume), title "Motor Vehicles," subtitle "Of-
fenses and Prosecutions," be and it is hereby repealed and re-
enacted, with amendments, to read as follows:

321.

Provided, however, that if any person arrested for the violation
of any of the provisions of this article or of Sections 231 or 232
of Article 27, as they may be amended from time to time, or of any
of Sections 135 through 157 of Article 56, comprising the subtitle
"Motor Vehicle Fuel Tax," as they may be amended from time to
time, or of Sections 422 or 423 of Article 81, as they may be amended
from time to time, or of Section 66A of Article 89B as it may be
amended from time to time
or of any public local law or of any
municipal ordinance or police regulation of Baltimore City, or of any
incorporated town or city in Maryland regulating traffic, is a resi-
dent of the State of Maryland, a resident of a county or the City
of Baltimore, other than that in which the arrest is made, such
person shall have the right to demand and receive and it shall be the
duty of the officer or officers arresting such person to inform him of
his right to make such demand and to comply with such demand if
made, a summons requiring him to appear on a day to be named
therein before said justice of the peace, police justice or trial magis-
trate or if in Baltimore City before the justice of the peace of the
traffic court, and the person so arrested shall signify his willingness
to appear before the justice of the peace, trial magistrate, police
justice, or justice of the peace of the traffic court if in Baltimore
City, named in said summons on the day therein, by endorsing his
name and address on said summons, and failing so to appear, the
said justice of the peace, trial magistrate, police justice, or justice
of the peace of the traffic court, as the case may be, before whom
