of said person or in lieu of said warrant shall send by registered
mail with return receipt requested a second summons to the violator
at his last known address setting the case for trial on a date at least
two weeks subsequent to the original date of trial.
Sec. 2. Be it enacted by the General Assembly of Maryland,
That Section 233 of Article 27 of the Annotated Code of Maryland
(1967 Replacement Volume), title and subtitle "Crimes and Punish-
ments," subheading "Fraud, Motor Fuels, Oils and Lubricants," be
and it is hereby repealed and re-enacted, with amendments, to read
as follows:
233.
Any person, copartnership or corporation, or any member, officer,
agent or employee of any copartnership or corporation, who shall
violate any provision of this subtitle, shall have the right to demand
and receive a summons in the same manner as is provided in Article
66½, Section 321 of the Annotated Code of Maryland and be guilty
of a misdemeanor and, upon conviction thereof, shall be punishable
by a fine of not more than two hundred dollars, or by imprisonment
for not more than six months, or by both such fine and imprison-
ment.
Sec. 3. Be it enacted by the General Assembly of Maryland,
That Section 153 of Article 56 of the Annotated Code of Maryland
(1968 Replacement Volume), title "Licenses," subtitle "Motor Vehi-
cle Fuel Tax," be and it is hereby repealed and re-enacted, with
amendments, to read as follows:
153.
Any dealer, person, association or persons, firm or corporation
violating any of the provisions of this subtitle, or any person, firm
or agent of any corporation who shall make any false statement in
connection with an application for the refund of any money or tax
as provided in this subtitle, or who shall collect or cause to be repaid
to him or to any person any tax without being entitled to the same
under the provisions of this subtitle, shall be deemed guilty of a
misdemeanor and shall have the right to demand and receive a sum-
mons in the same manner as is provided in Article 66½, Section 321
of the Annotated Code of Maryland and upon conviction thereof shall
be punished by a fine of not more than one thousand dollars
($1,000.00) or by imprisonment in the county jail for not more
than six (6) months, or by both such fine and imprisonment.
Sec. 4. Be it enacted by the General Assembly of Maryland,
That Section 429 of Article 81 of the Annotated Code of Maryland
(1969 Replacement Volume), title "Revenue and Taxes," subtitle
"Road Tax on Motor Carriers," be and it is hereby repealed and
re-enacted, with amendments, to read as follows:
429.
Any motor carrier who violates the provisions of Sections 422
or 423 of this subtitle shall be guilty of a misdemeanor and shall
