378                              Laws of Maryland                        Ch. 114

Code of Maryland (1969 Supplement), REPLACEMENT VOL-
UME), title "Higher Education," subtitles "Community Colleges"
and "State Colleges," be and the same are hereby repealed and
re-enacted, with amendments, to read as follows:

7(d).

Students from outside the State of Maryland who attend a com-
munity college or regional community college shall pay a full
fee which covers the [half] forty-five percent (45%) share of the
State, and also the thirty percent (30%) share of the political
subdivisions in addition to the regular fees and charges for students.
Out-of-county or out-of-region (or city) students from Maryland
who attend a community college or regional community college shall
pay fifty-five percent (55%) of a full fee, which includes the thirty
percent (30%) share of the political subdivisions in addition to
the regular fees and charges for students. Any political subdivision
may levy and appropriate funds to pay the thirty percent (30%)
share of the political subdivisions for its residents who attend a
community college in another political subdivision.

The board of trustees shall authorize all departments of instruc-
tion and all positions in the State colleges, shall fix the salaries
and tenure of all teachers, and all assistants of whatever kind, and
shall make all appointments to positions in a State college from
nominations submitted by its president; it may dismiss any teacher
or any assistant, upon the written recommendation of the president
of his college, for immorality, dishonesty, misconduct in office, in-
competence, insubordination and wilful neglect of duty, but no
teacher or professional assistant may be dismissed without being
given a copy of the charges against him and an opportunity of being
heard, in person or by counsel, in his own defense, upon not less
than ten days' notice. Appointments to and control of all positions,
except professional positions, shall be governed by Article 64A of
this Code, title "Merit System." The board of trustees shall au-
thorize the curricula to be offered, and subject to the provisions of
[Section 24 of this article] Section 11 of Article 77, it shall confer
such appropriate degrees as it shall determine and prescribe. It
shall prescribe all entrance requirements to the different depart-
ments and courses of study, including fees and admission charges;
it shall regulate the length of the regular sessions and provide and
arrange for summer sessions, and shall formulate rules and regula-
tions for the conduct and management of the State colleges.

Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1970.
