An Emergency Ordinance to repeal and re-enact, with amendments,
Section 15-707 (g) of the Anne Arundel County Code (1967 Edition
and Supplements), as amended by Bill No. 46-69, Title 15, "Public
Works", Subtitle 7, "Roads and Sidewalks", setting forth the condi-
tions under which interim emergency improvements may be made to
streets, avenues, roads or alleys completed prior to July 14, 1953.
Section 1. BE IT ENACTED BY THE COUNTY COUNCIL OF
ANNE ARUNDEL COUNTY, MARYLAND, That Section 15-707 (g) of
the Anne Arundel County Code (1967 Edition and Supplements), as amen-
ded by Bill No. 46-69, Title 15, "Public Works", Subtitle 7, "Roads and
Sidewalks", be, and it is hereby repealed and re-enacted to read as follows:
(g)(l) If the Director of Public Works or his designee determines
that the petition should be allowed he may, after the expiration of any
appeal period and with the written approval of the County Executive,
cause interim, emergency improvements to be made to the subject street,
avenue, road or alley and, in addition, he shall cause the Department
of Public Works to prepare an estimate for the cost of the necessary
improvements to the street, avenue, road or alley, including drainage and
appurtenances, to bring same up to then current county requirements
(except as stated in Subsection (g) (2) of this section). The estimate of
costs shall be then included in the next succeeding annual budget request
of the Department of Public Works and upon recommendation of such
item by the County Executive and approval thereof by the County Council,
the Director of Public Works shall formally approve the petition, have
the necessary conveyances prepared, initiate such condemnations as may
be necessary and, subject to budget limitations, proceed to have the
improvements made.
(g) (2) Subject to the other provisions of this section, the Director
of Public Works or his designee (subject to the written approval of
the County Executive) may cause interim emergency improvements to be
made to a street, avenue, road or alley not meeting County standards
as to grading, paving, width, drainage or construction, if it is first
