An Emergency Ordinance to add new Section 35-34A to the Anne
Arundel County Code (1957 Edition and Supplements), Chapter 35,
"Zoning", Article I, "In General", to follow immediately after Section
35-34 thereof, giving the County the authority to use lands which
it owns or leases in order to alleviate conditions dangerous to health
or safety.
Section 1. BE IT ENACTED BY THE COUNTY COUNCIL OF
ANNE ARUNDEL COUNTY, MARYLAND, That new Section 35-34A,
Chapter 35, "Zoning", Article I, "In General", be and it is hereby added
to the Anne Arundel County Code (1957 Edition and Supplements), to
follow immediately after Section 35-34 thereof, and to read as follows:
Section 35-34A
Notwithstanding any provisions of this Chapter to the contrary, upon
certification by the County Executive that an emergency condition exists
affecting the health or safety of the citizens of Anne Arundel County, the
County may make such use of any land it owns or leases as may be neces-
sary to alleviate said emergency. IN ANY MANNER WHATSOEVER,
PROVIDED:
(1) A RESOLUTION SHALL BE INTRODUCED BY THE
COUNTY COUNCIL THAT AN EMERGENCY CONDITION EXISTS
WHICH AFFECTS THE HEALTH OR SAFETY OF THE CITIZENS
OF ANNE ARUNDEL COUNTY.
(2) A PUBLIC HEARING THEREON SHALL BE SCHEDULED
NOT LESS THAN THREE (3) DAYS FOLLOWING ITS INTRODUC-
TION.
(3) SAID RESOLUTION SHALL SPECIFICALLY IDENTIFY
THE TRACT OF LAND TO BE USED, AND THE USE TO WHICH IT
SHALL BE PUT.
