2462                                Municipal Charters

pension equal to one and two-thirds percent (1⅔%) of his final earnings
for each year of credited service, provided that the total benefit does
not exceed sixty percent (60%) of his final earnings.

(b) A participant who has attained his fiftieth (50th) birthday but
not his sixtieth (60th) birthday and has completed at least twenty (20)
years of service may retire early and shall thereupon be entitled to receive
commencing on the first (1st) day of the month coinciding with or next
following his date of retirement a reduced annual pension equal to the
actuarial equivalent, determined by the insurance company, of his accrued
normal pension computed in accordance with the provisions of subsection
(a) above on the basis of the participant's credited service completed
prior to actual retirement.

Section 1-222

(a)   An employee who is not eligible to retire on a normal retirement
pension may be retired by the Personnel Officer on a non-service connected
disability retirement pension beginning on the first day of the month
coinciding with or next following the date the following conditions are
met:

(1) he is eligible for disability benefits under the provisions of the
Social Security Act as constituted on the date he becomes eligible for
disability payments under this Plan, and the Personnel Officer finds him
on the basis of a medical examination by a physician or physicians
selected by the County,

(1)   To be wholly and permanently prevented from engaging in any
occupation or employment for remuneration or profit not as a result
of bodily injury in the performance of duty or occupational disease incurred
in the performance of duty, or

(ii) To be wholly and permanently prevented from continuing in
his capacity as an employee not as a result of bodily injury in the
performance of duty or occupational disease incurred in the performance
of duty.

(2)   he has exhausted all sick leave and any accident and sickness
benefits from programs, exclusive of federal Social Security, to which
County makes contributions.

(3)   he was making participant's contributions to this plan immedi-
ately prior to his date of disability.

(4)  he has five years of service.

(5)  he is not eligible for service connected disability retirement.

(b)   An employee who is not eligible to retire on a normal retire-
ment pension may be retired by the Personnel Officer on a service con-
nected disability retirement pension beginning on the first day of the
month coinciding with or next following the date the following conditions
are met:

(1) the Personnel Officer determines on the basis of a medical exam-
ination by a physician or physicians selected by the Personnel Officer
that he is totally and permanently incapacitated as the natural and prox-
imate result of bodily injury in the performance of his regular occupation
or occupational disease incurred in the performance of his regular occu-
pation at some definite time or place, without willful negligence on his
