will be returned to him 12 months from completion of the fill. If the
licensee fails to fulfill his obligations, the County may use these funds to
make all necessary maintenance repairs and do other work as necessary
either by force account with its own personnel and equipment or by con-
tract with an outside party, or parties, as the County deems most feasible;
in which case the County will refund to the licensee any remaining balance
after deducting all direct costs plus one hundred per cent for overhead
costs. IF ANY PART OR ALL OF THE LICENSEE'S BOND IS USED
FOR THE AFOREMENTIONED PURPOSE, THEN THE LICENSEE
SHALL FORFEIT ANY FUTURE RIGHT OF RE-LICENSING IN THE
COUNTY.
(7) A plat of completed landfill or such portions thereof as may be
accepted as completed, shall be filed with the Department of Public Works
and the Department of Health, Anne Arundel County.
Section 11-412
It is recognized that the extent of required facilities and utilities will
vary with the size of the landfill operation. Consideration of requests for
waiver or relaxation of any provisions of this regulation will be given at
the time of license application submittals.
Section 11-412
(a) Licenses currently active will remain in force until expiration
date, unless revoked by the Department of Inspections and permits upon
recommendation of the Department of Health.
(b) Completion maintenance bonds for existing landfills will be
furnished to the Department of Public Works within ninety (90)
days after enactment of this regulation ORDINANCE. The amount
of the bond will be based on the number of acres planned or intended
to be employed during the current permit period, plus the acreage
employed during the twelve (12) months preceding current license
period.
(c) All operations at existing landfills will be brought up to
standards to meet the design criteria and operational standards, pre-
scribed by this regulation ORDINANCE, within the six (6) month
period after the enactment of the Solid Waste Ordinance EFFECTIVE
DATE HEREOF.
Section 11-413
If any provision of this ordinance, or the application thereof to any
person or circumstances is held invalid, the remainder of this ordinance
and the application of such provision to persons or circumstances other
than those as to which it is held invalid, shall not be affected hereby.
Section 11-414
If any provisions or part of a provision of this ordinance or any
regulations pursuant thereto are in conflict with any other ordinance
existing on the effective date of this ordinance, including but not limited
to water pollution, air pollution, or the Fire Prevention Code of Anne
Arundel County, then this ordinance shall control.
Section 11-415
Any person convicted of any violation of this ordinance and the
regulations passed in pursuance thereto shall be deemed guilty of a
