misdemeanor and shall be fined for each such violation a sum of not
more than $500 FOR EACH DAY SAID VIOLATION CONTINUES,
or 90 days of imprisonment in the discretion of the court, OR BOTH
FINE AND IMPRISONMENT.

Section 2. AND BE IT FURTHER ENACTED, That Section
6-301 be, and it is hereby repealed and re-enacted to read as follows:

Section 6-301

Except as set forth in Title 11, Subtitle 4 (Sanitary Landfill):

(a)    No person shall dispose of, deposit or dump any rubbish,
garbage or refuse upon any vacant lot or tract of land in the county.

(b)    No person shall dispose of, deposit or dump any rubbish,
garbage or refuse upon any highway, byway, walkway or alley, parking
lot, including shopping center or drive-in parking lots of any kind
used in the county, whether or not maintained by the county.

(c)    No person shall store any rubbish, garbage or refuse except
as provided by law.

(D) ANY PERSON CONVICTED OF A VIOLATION OF THIS
SECTION SHALL BE GUILTY OF A MISDEMEANOR AND UPON
THE FIRST CONVICTION THEREOF SHALL BE PUNISHED BY
A FINE NOT LESS THAN $50.00 NOR MORE THAN $250.00 AND
UPON THE SECOND CONVICTION THEREOF SHALL BE PUN-
ISHED BY A FINE OF NOT LESS THAN $100.00 NOR MORE
THAN $500.00 AND BY IMPRISONMENT IN THE COUNTY JAIL
FOR A PERIOD NOT EXCEEDING 30 DAYS OR BOTH.

Section 3. AND BE IT FURTHER ENACTED, THAT IF ANY
PROVISION OF THIS ORDINANCE OR THE APPLICATION
THEREOF TO ANY PERSON OR CIRCUMSTANCE IS HELD IN-
VALID FOR ANY REASON, SUCH INVALIDITY SHALL NOT
AFFECT THE OTHER PROVISIONS OR ANY OTHER APPLICA-
TION OF THIS ORDINANCE WHICH CAN BE GIVEN EFFECT
WITHOUT THE INVALID PROVISIONS OR APPLICATION, AND
TO THIS END, ALL PROVISIONS OF THIS ORDINANCE ARE
HEREBY DECLARED TO BE SEVERABLE.

Section 3 4. AND BE IT FURTHER ENACTED, That this
Ordinance shall take effect forty-five (45) days from the date it becomes
law.

READ AND PASSED this 6th day of May, 1969.
