(2) The applicant has facilities to provide towing services when
requested on a twenty-four hour basis.
(3) The towing vehicles of the applicant are in good mechanical
condition, equipped with necessary towing gear and safety apparatus,
and are registered as commercial hauling vehicles with the department
of motor vehicles.
(b) The chief of police or his designee shall promptly report his
findings to the director of inspections and permits. If the director shall
deny any license based upon such findings, the same shall be appealable
as provided in Section 12-1415. (Bill No. 84 (1965), S. 1.)
Section 12-1406. Same—Location restricted.
No licensee shall operate from more than one location within the
county nor shall any licensee change the location of his business without
notifying the director of inspections and permits at least sixty days in
advance of such change. Each licensee shall have only one business tele-
phone number, but may have an extension of such telephone in his home
or at any other location where he may be regularly contacted.
Section 12-1408. List of licenses to be furnished police department;
The director of inspections and permits shall furnish the police depart-
ment current lists of all duly licensed towing operators. Whenever the
services of a towing vehicle shall be required and a request is made to the
police department for the providing of such services, the police department
shall have dispatched to the place where the services are required, a vehicle
operated by that towing operator whose place of business is closest to the
scene of the accident. In the event the towing operator who is closest
to the scene of the accident does not then have a towing vehicle available
for service, the police department shall call the next closest towing opera-
tor and so on until a towing vehicle has been secured. If a towing vehicle
does not arrive at the scene of a collision or accident within 20 minutes
after request is made, the officer at the scene shall notify the police depart-
ment of such fact. The police department shall then contact the towing
company to ascertain the cause for the delay. If the police department
is not reasonably satisfied that a towing vehicle will arrive at the scene
within five minutes after such second call, it shall contact the next closest
towing company, etc., as if the first towing company had not been con-
tacted. Consideration will be given, however, to abnormal traffic patterns
that result from adverse weather conditions, emergencies, or other cause.
Upon arriving at the scene of an accident, the towing operator shall
immediately remove the disabled vehicle to his storage lot if he received
the call during the regular business day. If such call was not received
during the regular business day, he shall be allowed to store the disabled
vehicle at a location other than his storage lot until noon of the next
business day. In the event a disabled vehicle cannot promptly and effi-
ciently be removed from the scene of an accident, the towing operator may
call the next closest licensee to assist in such removal. A towing operator
shall be required to release disabled vehicles only during the regular
business day, but may release such a vehicle to the owner at other times.
Nothing herein contained shall be construed as interfering in any way
with the right of any person to call a towing operator of his own choice to
send a towing vehicle to the scene of an accident whether such towing
operator is licensed or not; provided, however, that such towing operator
can dispatch a towing vehicle to the scene of the accident which can arrive
