ANNE ARUNDEL COUNTY

An Emergency Ordinance to repeal and re-enact, with amend-
ments, Sections 12-1400, 12-1405, 12-1406 and 12-1408 of the Anne
Arundel County Code (1967 Edition and Supplements), heading
"Title 12. Licenses, Permits and Inspections," subheading "Subtitle
14. Towing Companies," and to add new Section 12-1405A to the said
Code under the said heading and subheading to follow immediately
after Section 12-1405 thereof, revising generally certain provisions
relating to the licensing of towing operators and the procedure of
such operators.
Section 1. BE IT ENACTED BY THE COUNTY COUNCIL OF
ANNE ARUNDEL COUNTY, MARYLAND, That Sections 12-1400, 12-
1405, 12-1406, and 12-1408 of the Anne Arundel County Code (1967 Edition
and Supplements), heading "Title 12. Licenses, Permits and Inspections,"
subheading "Subtitle 14. Towing Companies," be and they are hereby
repealed and re-enacted, with amendments, to read as follows:
Section 12-1400. Definitions.
For the purposes of this subtitle the following words and phrases
shall have the meanings respectively ascribed to them by this section:
Disabled vehicle. A motor vehicle which has been damaged or rendered
inoperative as the result of a collision or accident and not as a result of
wear and tear or mechanical failure.
License. A license to engage in towing disabled vehicles from or
through the streets of the county, issued pursuant to this subtitle.
Regular business day. That period between the hours of 8:00 A.M.
and 5:00 8:00 P.M., Monday through Friday.
Towing. The moving or removing or the preparation thereof of a
disabled vehicle by another vehicle for which service charge is made,
either directly or indirectly. A charge made indirectly refers to dues or
other charges of bona fide clubs or associations which provide towing
services.
Towing company. A natural person, partnership, corporation, fidu-
ciary, association or other entity owning, operating or conducting the
business of disentangling, removing or towing vehicles damaged by colli-
sion or other accident.
Towing vehicle. A vehicle that tows, carries or removes a disabled
vehicle for a fee charged either directly or indirectly. A fee charged in-
directly refers to dues or other charges of clubs or associations which
provide towing services. (Bill No. 84 (1965), S.1)
Section 12-1405. Same Investigation and findings on application.
(a) The director of inspections and permits, after receipt of an
application for license, shall forward same to the chief of police or his
designee for investigation and inspection of the following:
(1) The applicant has adequate off-street storage facilities [not
necessarily located at the same location] within five ROAD miles of the
location where his towing vehicles are located, in an area so that stored
vehicles will not be visible from any state or county highway.
