2388                               Municipal Charters

unless a proper petition for a referendum hereon shall be filed as permitted
by law. A complete and exact copy of this Resolution shall be posted in
the City Hall until November 29, 1969, and a copy of the Title of this
Resolution shall be published in a newspaper of general circulation in the
City of Rockville not less than four (4) times, at weekly intervals, before
November 29, 1969.

Section 3. AND BE IT FURTHER RESOLVED that as soon as the
charter amendment hereby enacted shall become effective, either as herein
provided or following a referendum, the Mayor and Council of Rockville
shall send separately, by registered mail, to the Secretary of State of
Maryland, and to the Department of Legislative Reference, the following
information concerning the charter amendment: (1) the complete text
of Section 48-60 of the Charter of The Mayor and Council of Rockville,
as hereby enacted; (2) the date of the referendum election, if any, held
with respect thereto; (3) the number of votes cast for and against the
question containing the charter amendment, whether by the Council of
The Mayor and Council of Rockville or in a referendum; and (4) the
effective date of the charter amendment.

Section 4. AND BE IT FURTHER RESOLVED that the Mayor and
Council of Rockville be and he is hereby specifically enjoined and instructed
to carry out the provisions of Sections 2 and 3. As evidence of compliance
herewith, the said Mayor shall cause to be affixed to the minutes of this
meeting (1) appropriate certificates of publication of the newspaper in
which the Title of this Resolution shall have been published and (2) the
return receipts of the mailing referred to in Section 3, and shall further
complete and execute the Certificate of Effect attached hereto.

I HEREBY CERTIFY that, in connection with Charter Amendment
CA No. 21, also being Resolution No. 60-69 of the Mayor and Council of
Rockville, Maryland, whereby the Charter of the City of Rockville was
amended under Section 48-60. The title of said Resolution, which also
serves to summarize its content, being as follows: "RESOLUTION of The
Mayor and Council of Rockville adopted pursuant to the authority of
Article 11E of the Constitution of Maryland, Section 13 of Article 23A
of the Annotated Code of Maryland (1966 Replacement Volume, title
"Corporations—Municipal," subtitle "Home Rule," and Sections 48-15A
to 48-15G, inclusive, of the Charter of The Mayor and Council of Rockville,
as amended, to amend the Charter of The Mayor and Council of Rockville,
as set forth in Sections 48-1 to 48-95, inclusive, of the Code of Public Local
Laws of Montgomery County (1965 Edition, as amended, being Article
16 of the Code of Public Local Laws of Maryland) to repeal and re-enact,
with amendments, Section 48-60 thereof, to eliminate duplicate authority
for the issuance of general obligation bonds payable primarily from special
assessments as contained in Section 48-60 (h) and confirming that all
such bonds may be issued pursuant to the authority of Section 48-29 of
said Code."

a. The vote on the Resolution to amend the Charter showed that
Councilmen Curry, Bryan, Hanna, McCartin and Mayor Tuchtan voted in
the affirmative, with no Council member voting in the negative, and with
no Council member either abstaining or being absent.
