amendments thereof and additions thereto, and to enact in lieu thereof
the municipal corporation charter contained in Article 23B of the An-
notated Code of Maryland, with certain exceptions, entitled "Municipal
Corporation Charter" so that in the future the citizens of the Town of New
Market in Frederick County, a body corporate, shall be governed under
and according to the said "Municipal Corporation Charter" [.] with
certain exceptions.
Section 1. BE IT RESOLVED by the Commissioners of the Town of
New Market that Sections 634 to [643] 653, inclusive, of Article 11
of the Code of Public Local Laws of Maryland (1930 Edition), title
"Frederick County," subtitle "New Market" and all subsequent amend-
ments thereof and additions thereto be and the same are hereby repealed
and in the future the citizens of the Town of New Market in Frederick
County, a body corporate, shall be governed under and according to the
municipal corporation charter contained in Article 23B of the Annotated
Code of Maryland (1957), entitled "Municipal Corporation Charter" [.]
with the following exceptions:
8. The newly elected council shall meet [at 8:00 P.M. on the second
Monday following its election] within two (2) weeks following its election
on a day and at an hour designated by the Mayor within three (3) days
following said election, for the purpose of organization, after which the
council shall meet regularly at such times as may be prescribed by its
rules but not less frequently than once a month. Special meetings shall
be called by the [clerk-treasurer] Mayor or the clerk to the council upon
the request of the mayor or a majority of the members of the council. All
meetings of the council shall be open to the public, and the rules of the
council shall provide that residents of the town shall have a reasonable
opportunity to be heard at any meeting in regard to any municipal question.
14. [No] An ordinance [shall] may be passed at the meeting at
which it is introduced [.] ,provided it is typed or written in final form.
[at any regular or special meeting of the council held not less than six
nor more than sixty days after the meeting at which an ordinance was
introduced, it shall be passed, or passed as amended, or rejected, or its
consideration deferred to some specified future date. In cases of emer-
gency the above requirement may be suspended by the affirmative votes
of four members of the council]. Every ordinance, unless it be passed
as an emergency ordinance, shall become effective at the expiration of
twenty calendar days following approval by the mayor or passage by the
council over his veto. Each ordinance shall be published [at least twice
in a newspaper or newspapers having general circulation in the munici-
pality] by posting copies of the same for ten (10) days at two public
places in the town to be determined by the council enacting the same. In
cases of [A] An emergency [an] ordinance may be passed by unanimous
vote of the council and shall become effective on the date specified in the
ordinance but no ordinance shall become effective until approved by the
mayor or passed over his veto by the council.
35. It shall be the duty of the board of supervisors of elections to
provide for each special and general election a suitable place or places for
voting and suitable ballot boxes and ballots or voting machines. The ballots
or voting machines shall show the name of each candidate nominated for
elective office in accordance with the provisions of this Charter, arranged
in alphabetical order by office with no party designations of any kind.
The board of supervisors of elections shall keep the polls open from [9:00
A.M.] 12:00 o'clock, noon, to 8:00 P.M. on election days or for longer
hours if the council by resolution requires it.
