AN ACT to repeal and re-enact, with amendments, Sections 31, 33,
35(a), 67(1), and 67(3a) of Article 101 of the Annotated Code of
Maryland (1964 Replacement Volume and 1969 Supplement), title
"Workmen's Compensation," subtitles "Application of Article;
Extra-Hazardous Employments" and "Miscellaneous," respec-
tively; to repeal Sections 21, 67(2) and 67(3) of said Article of
said Code, title and subtitles and enact new Sections 21, 67 (2) and
67(3) in lieu of the sections so repealed; and to repeal Sections
35 (d) and 67(4) of said Code, title and subtitles, all to revise the
requirements for coverage of employees under this Article, to
change the definitions of employment, employer and employee;
to repeal the section which applies to coverage of prisoners en-
gaged in employment in certain counties; to repeal the section
which defines employment under certain conditions; and relating
generally to the Workmen's Compensation Law of Maryland.
Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 31, 33, 35(a), 67(1), and 67(3a) of Article 101 of
the Annotated Code of Maryland (1964 Replacement Volume and
1969 Supplement), title "Workmen's Compensation," subtitles
"Application of Article; Extra-Hazardous Employments" and "Mis-
cellaneous," respectively, be and they are hereby repealed and re-
enacted, with amendments; that Sections 21, 67(2) and 67(3) of
said Article of said Code, title and subtitles be and they are hereby
repealed and that new Sections 21, 67(2) and 67(3) be and they are
hereby enacted in lieu thereof; and that Sections 35(d) and 67(4)
of said Code, title and subtitles be and they are hereby repealed, all
to read as follows:
21.
(a) Coverage of Employers. The following shall constitute em-
ployers subject to the provisions of this Act:
(1) Every person that has in the State one or more employees
subject to this Act.
(2) The State, any agency thereof, and each county, city, town,
township, incorporated village, school district, sewer district, drain-
age district, public or quasi-public corporation, or any other political
subdivision of the State that has one or more employees subject to
this Act.
(b) Coverage of Employees. The following shall constitute em-
ployees subject to the provisions of this Act, except as exempted
under subsection (c) of this section:
(1) Every person, including a minor, whether lawfully or unlaw-
fully employed, in the service of an employer under any contract of
hire or apprenticeship, express or implied, and all helpers and assist-
ants of employees whether paid by the employer or employee, if em-
ployed with the knowledge, actual or constructive, of the employer.
