The provisions of this subheading shall not apply to the solicitation
or sale of insurance OR TO THE SALE OF SERVICES SUBJECT
TO JURISDICTION OF THE PUBLIC SERVICE COMMISSION
OR THE HOME IMPROVEMENT COMMISSION OF MARY-
LAND.

This subheading may be cited as the "Home Solicitation Sales
Act."
Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1970.

AN ACT to add new Section 21D to Article 83 of the Annotated
Code of Maryland (1969 Replacement Volume), title "Sales and
Notices," subtitle "Consumer Protection," to follow immediately
after Section 21C thereof, providing that the notification to any
person, as part of an advertising scheme or plan, that he has won
a prize and requiring him to do any act, purchase , RECEIVED
AN AWARD, OR HAS BEEN SELECTED OR IS ELIGIBLE
TO RECEIVE ANYTHING OF VALUE WHICH IS CONDI-
TIONED UPON HIS PURCHASING any other item or submit
SUBMITTING to a sales promotion effort shall constitute an un-
lawful practice AND TO EXEMPT TRADING STAMPS FROM
THE PROVISIONS OF THIS ACT.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 21D be and it is hereby added to Article 83 of the
Annotated Code of Maryland (1969 Replacement Volume), title
"Sales and Notices," subtitle "Consumer Protection," to follow imme-
diately after Section 21C thereof, to read as follows:
21D.
The notification to any person by any means, as part of an
advertising scheme or plan, that he has won a prize and requiring
him to do any act, purchase , RECEIVED AN AWARD, OR HAS
BEEN SELECTED OR IS ELIGIBLE TO RECEIVE ANYTHING
OF VALUE WHICH IS CONDITIONED UPON HIS PURCHAS-
ING any other item, or submit SUBMITTING to a sales promotion
effort constitutes an unlawful practice under this subtitle. THE
PROVISIONS OF THIS SECTION DO NOT APPLY TO TRAD-
ING STAMPS AS DEFINED BY SECTION 239(A) OF ARTICLE
56 OF THE ANNOTATED CODE.
Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1970.
