CHAPTER 580
(House Bill 249)

AN ACT to repeal and re-enact, with amendments, Sections 124 (b)
and 125 of Article 77 of the Annotated Code of Maryland (1969
Replacement Volume), title "Public Education," subtitle "Chapter
9. Finance and Reports," and to add a new Section 126 thereto, to
follow immediately after said Section 125, amending the public
school laws to require certain facilities for students to have lunch
in school and requiring certain State Board of Education to
provide a
program of subsidized and/or free lunches for under privileged
children, and
relating generally to this program TO ESTABLISH
A STATE FREE FEEDING PROGRAM FOR THE PUBLIC
SCHOOLS; TO INCLUDE THE APPROPRIATIONS FOR THIS
PROGRAM IN THE GENERAL STATE SCHOOL FUND AN-
NUAL STATE BUDGET, TO SET FORTH THE POLICIES IN
REGARD TO THE PROGRAM AND RELATING GENERALLY
TO PROVIDING FREE FEEDING PROGRAMS IN THE
PUBLIC SCHOOLS.

Section 1. Be it enacted by the General Assembly of Maryland,
That Sections 124(b) and 125 of Article 77 of the Annotated Code of
Maryland (1969 Replacement Volume), title "Public Education,"
subtitle "Chapter 9. Finance and Reports," be and are hereby re-
pealed and re-enacted, with amendments, and new Section 126 be
and it is hereby added to the same Article, title and subtitle, to follow
immediately after said Section 125 thereof, and all to read as follows:

124.

(b) The Comptroller shall charge against and pay as herein-
before or hereinafter provided from the General State School Fund,
the annual appropriation made by the General Assembly for the
support of the State Department of Education, including the ex-
penses of the State Board of Education, and the support and expenses
of the office of the State Superintendent of Schools; the annual
appropriation for the Maryland Teachers' Retirement System; the
annual appropriation for the education of handicapped children; the
annual appropriation for a subsidized and/or free lunch program
FEEDING PROGRAMS; the annual appropriation for administra-
tion and supervision of vocational education in public high and
vocational schools, for physical education and recreation, for medical
examination of school bus drivers, for case and guidance service for
handicapped individuals needing vocational rehabilitation, for
equivalence examinations, for public libraries, and for adult educa-
tion; the annual appropriation for the State share of current expenses
and annual current expense incentive aid as provided in Sections 128
and 129 of this article; the necessary costs of transporting pupils to
public schools when such transportation is approved by the State
Superintendent of Schools; and the school building construction aid
as provided in Section 130 of this article.

125.

The State Board of Education is hereby authorized to accept for
the State of Maryland any appropriation of money for any educa-
tional purposes or subsidized and/or free lunch FEEDING programs
