AN ACT to repeal Section 6 (b) of Article 73B of the Annotated
Code of Maryland (1967 Replacement Volume), title "Pensions,"
subtitle "In General," and to enact new Section 6 (b) in lieu
thereof, to stand in the place of the section repealed, to establish
certain conditions of eligibility to receive service credit for certain
employees who become members of the Retirement System.
Section 1. Be it enacted by the General Assembly of Maryland,
That Section 6 (b) of Article 73B of the Annotated Code of Mary-
land (1967 Replacement Volume), title "Pensions," subtitle "In
General," be and the same is hereby repealed, and new Section 6 (b)
be enacted in lieu thereof to stand in the place of the section re-
pealed and to read as follows:
6.
(b) [Any person who was an employee on October 1, 1941, who
elected in 1941 or 1942 not to be covered in the membership of the
retirement system, who has been an employee continuously after
October 1, 1941, and who subsequently joined the retirement system
as a new member, shall have a similar opportunity to elect to be
covered by the provisions of this section. Any such person shall pay
to the retirement system the full amount of what would have been
his accumulated contributions therein for the period from October
1, 1941 to the date on which he subsequently became a new member
of the system, had he in fact belonged to the system during such
period, together with regular interest thereon. The State shall make
a matching contribution for the same period and also shall pay the
prior service credit for such person, as provided hereinabove.]
An employee whose membership in the Retirement System was
contingent on his own election and who elected not to become a mem-
ber may thereafter apply for and be admitted to membership. Such
a person shall receive prior service credit for service rendered prior
to the date he was first eligible to become a member and member-
ship credit for service rendered subsequent thereto, provided that he
shall pay to the Retirement System by a single payment prior to his
retirement or death, the contributions which he would have made
had he in fact belonged to the system during the period he was
eligible, together with regular interest to the date of payment.
Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1970.
