compensation for such employment as of February 1, 1961, and who
previously served as a desk officer or employee of either house of the
General Assembly and received per diem compensation for such
previous service, shall be entitled to prior service credit equal to four
years for any four-year term of a General Assembly during which
such previous service was rendered.

Sec. 2. And be it further enacted, That this Act shall take effect
July 1, 1970.

CHAPTER 550

(Senate Bill 312)

AN ACT to repeal and re-enact, with amendments, Section 12 (c) of
Article 77A of the Annotated Code of Maryland (1969 Replace-
ment Volume), title "Higher Education," subtitle "State Colleges,"
correcting the laws to include as members of the Employees' Re-
tirement System all employees other than the executive director
and the professional employees of the State colleges.
PROVIDE
THAT EMPLOYEES OF THE BOARD OF TRUSTEES OF THE
STATE COLLEGES SHALL BE MEMBERS OF EMPLOYEES'
RETIREMENT SYSTEM OR THE TEACHERS' RETIREMENT
SYSTEM.

Section 1. Be it enacted by the General Assembly of Maryland,
That Section 12 (c) of Article 77A of the Annotated Code of Mary-
land (1969 Replacement Volume), title "Higher Education," subtitle
"State Colleges," be and it is hereby repealed and re-enacted, with
amendments, to read as follows:

12.

(c) Executive director; employees subject to merit system; mem-
bership in Teachers' Retirement System.—The board shall appoint
a qualified person as executive director who shall serve at the pleas-
ure of the board and receive such salary as is provided in the
budget. The executive director shall be the chief administrative of-
ficer of the board; he shall keep a record of all meetings of the
board, maintain and preserve all books, records and papers of the
board, and perform such other duties as the board may prescribe.
The board shall also appoint at the recommendation of the execu-
tive director such other staff members as may be necessary to carry
out the duties of the board. The employees of the board, with the
exception of the executive director and professional employees who
shall not be included in the classified service, shall be subject to the
provisions of Article 64A of this Code, title "Merit System." The
executive director and all professional [and clerical] employees of
the board shall be eligible for membership in and shall become mem-
bers of the Teachers' Retirement System of the State of Maryland.
All other employees shall be eligible for membership in and shall be-
come members of
OR the Employees' Retirement System of the State
of Maryland.
