supervision of the other Assistant Attorneys General assigned to
the Department. After the Attorney General has designated an
Assistant Attorney General to serve as Counsel to the Department
of Personnel, he shall not reassign said Counsel without consultation
with the Secretary of Personnel. The Counsel to the Department
of Personnel, and the other Assistant Attorneys General so employed,
shall each perform such legal duties for the Department as the
Attorney General may, from time to time, assign to them; and the
Attorney General is hereby authorized to assign to them, and each
of them, the performance subject to his discretion and control, of
any of the duties with respect to said Department required of him
by law. All such Assistant Attorneys General shall be practicing
lawyers of the State of Maryland, in good standing, and they shall
receive such compensation as shall be provided in the State budget.
This subsection shall not apply with respect to any agencies or units
of Government within the Department of Personnel to the extent
that such agencies or units are authorized by law to employ their
own legal advisors or counsel.
216.
(a) The following Agencies and Boards shall be included within
the Department of Personnel: The Office of the Secretary of Per-
sonnel as provided for in this Article and in Article 64A of this
Code; the Board of Ethics established by the Governor pursuant to
Section 14A of this Article and Article 19A, Section 3, of this Code;
the Board of Trustees of the Employees' Retirement System of the
State of Maryland provided for in Article 73B, Section 12, of this
Code; the Board of Trustees of the Teachers' Retirement System of
the State of Maryland provided for in Article 77, Section 196, of
this Code; the Board of Trustees of the State Police Retirement
System of the State of Maryland provided for in Article 88B, Section
54,, of this Code; and such other agencies, commissions, boards, com-
mittees, councils or units of government as may hereafter pursuant
to law be declared to be part of the Department of Personnel.
(b) The Department of Personnel shall not have a Board of
Review, and Section 3C of this Article shall be inapplicable to the
Department of Personnel.
217.
(a) The Secretary of Personnel shall be responsible for the
budget of his office and for the budgets of the other boards, offices
and agencies within the jurisdiction of the Department of Personnel.
(b) The Secretary of Personnel shall be responsible for promul-
gating rules and regulations for his office. He shall review and shall
have the power to approve or disapprove or revise the rules and
regulations of all of the boards, offices and agencies within the
jurisdiction of the Department of Personnel, except for the rules
and regulations of the Boards of Trustees of the retirement systems
for AND the administration of the funds created by Article 73B,
Article 77, Subtitle "Teachers' Retirement System", and Article 88B,
Subtitle "State Police Retirement System", of this Code.
(c) The Secretary of Personnel may, in his discretion, create
such advisory boards of such size as he deems appropriate.
