§ 6-104. Class of Licenses.

(a)    The Department, upon issuing a driver's license, shall indi-
cate thereon the type or general class(es) of vehicle(s) the licensee
may drive.

(b)    The Department shall establish such qualifications as it be-
lieves reasonably necessary for the safe operation of the various
types, sizes, or combinations of vehicles, and shall appropriately
examine each applicant to determine his qualifications according to
the type or general class of licenses applied for.

§ 6-105. Instruction and Examination License.

(a)    A person who desires to obtain a driver's license or who
desires to be licensed in a class for which he is not already licensed
shall apply to the department for the class or classes of license in
which he desires to be licensed. Except as hereinafter authorized,
the department shall issue to each applicant an instruction and ex-
amination license prior to issuing a driver's license. The instruction
and examination license shall clearly identify the class of license
applied for, as provided in Section 6-102.2.

(b)    An instruction and examination license shall entitle the per-
son to whom it was issued to drive vehicles and combinations of
vehicles of the class or classes specified herein, as described more
particularly in Section 6-102.2 with respect to drivers, but only while
the holder of the instruction and examination license is accompanied
by and under the immediate supervision of a person who:

1. Is at least 21 years old;

2 1. Is licensed in Maryland or in another state to drive vehicles
of the class then being driven by the holder of the instruction and
examination license;

3 2. Is actually occupying a seat beside the holder of the instruc-
tion and examination license, unless the vehicle is a motor-driven
cycle. A motorcycle learner's permit shall entitle the holder thereof
to operate a motorcycle on the highways, as a learner, while under
the instruction and immediate supervision of a licensed motorcycle
operator. Motorcycle learners shall carry only an instructor properly
licensed to operate a motorcycle.

(c)    A person to whom an instruction and examination license
has been issued may take the final examination for a driver's license
no sooner than 14 days from the date the instruction and examina-
tion license was issued.

(d)    An instruction and examination license shall expire 60 days
after the date it is issued.

(e)    A driver's license may be issued without the prior issuance
of an instruction and examination license, and without a 14-day
waiting period, to any person who has been regularly licensed to
drive in another state or country or by the Armed Forces of the
United States, if the Department is satisfied that the applicant's
experience in driving vehicles which may be driven by holders of the
class or classes of license sought by the applicant is sufficient to
justify the issuance of the license without further behind-the-wheel
training.
